Can a coaching agreement be terminated early if the coach fails to deliver the promised services?

I entered into a coaching agreement with a coach who promised to provide me with specific coaching services, but after a few sessions, it became clear that the coach was not delivering on those promises. I am now considering terminating the agreement early, but I am not sure if I have the legal right to do so or if I would be entitled to any refunds or compensation for the services not rendered.

Hello! I'm so sorry for this situation. Generally, the answer to your question is yes. Why? A breach of contract simply means that one party was obligated to perform and they have either not performed or have said that they will not perform. (Restatement (Second) of Contracts.) This applies regardless of whether the agreement was written or done orally. Typically, the aggrieved party is entitled to be returned to the same position they were in before the breach. In other words, if you aren't getting the coaching for which you paid, you can pursue one of those remedies. We are more than happy to review the contract for you to verify. Best of luck! Dolan

I am currently in the United States on an H-1B visa and I have been considering starting my own business. However, I am unsure if it is legally permissible for an H-1B visa holder to do so. I have heard conflicting information and want to understand the specific regulations and requirements that apply to H-1B visa holders who wish to start a business in the US.

The short answer is: likely yes. The issue of your visa and owning a business are mutually exclusive. HOWEVER, you H1B visa is sponsored by your current employer, if you leave that employment without another visa, you have to leave the country. I HIGHLY recommend you speak with an immigration AND a business attorney to determine how the two issues may conflic, or how you can thread the needle so as to avoid issues on both matters. Hello and welcome to ContractsCounsel.com! My name is Dolan. So first things first is the scope of work. You don't want "project creep" to show up. Lawyers often have to deal with this as well because sometimes the scope of what we do is exceeded by clients on occasion, so being clear on the scope is super important. Also, if you’re both putting in money or other resources, spell out what those are and how they’ll be tracked and you might want to include details on how future expenses will be approved and who’s footing the bill for what. Confidentiality and what to do with the IP is also going to be super important, too. Also, other things like what happens if a party doesn't perform, how you'll handle disputes, where you will handle them, and where notices will be sent are super important. Also, what about decision-making disputes? Think about how those will get handled. Finally, think about profit sharing as well! Come on back to this site and we can draft one up for you!

I am an independent contractor and freelancer in San Diego, California. I am a sole proprietor who offers training and consulting services. I use a contract agreement with my clients. Even after signing my contract, this client is unwilling to compensate me for the hours I spent working on his project. I would like to send this client a collections notice for non-payment. I would appreciate knowing the process. Thanks in advance

I have been given a contract that says 'Fixed Term Employment Contract'. How is this different than a normal employment contract? Is there anything I need to consider before signing this?

This is an agreement that has a fixed amount of years which is agreed to by the employer and the employee. These types of agreements usually have a term of say 1, 2, or 3 years and often are renewable for another fixed term
