Can a content creator agreement be terminated by the platform without prior notice or warning?
I am a content creator who has been using a popular online platform to showcase and monetize my work for the past year. Recently, without any prior notice or warning, the platform terminated my content creator agreement, effectively shutting down my account and removing all my content from the platform. This has caused significant financial loss and distress, as I heavily relied on the platform for income. I would like to know if the platform had the right to terminate my agreement without any notice or warning, and if there are any legal remedies available to me in this situation.

Depends on what the content creator agreement with the platform says about termination. It likely has the platform covered. If they didn't follow the terms of the agreement, you might have a claim. The claim may be limited in damages as most of these contracts, if well written, have limitations on damages under the contract.

I am a small business owner and I am considering offering an Employee Separation Agreement to an employee who is leaving the company. I want to understand the pros and cons of this type of agreement so that I can make the best decision for my business.

There are several reasons for using an employee separation agreement - it can be used to protect confidential information and IP, obtain general liability waiver for certain legal claims (e.g., wrongful termination), offer an employee certain benefits and severance pay, and include additional provisions (e.g., non-disparagement clause so the employee cannot spread negative information about the company, return of company equipment, etc.). Just as an employer is not legally required to offer a severance agreement, an employee is not required by law to sign a severance agreement. However, an employee may be more likely to sign a reasonable, balanced severance agreement. Can a repayment agreement be enforced if it was made verbally and not in writing?
I recently loaned a significant amount of money to a friend in need, and we agreed on a repayment plan where they would pay me back in monthly installments. However, we did not put this agreement in writing, and it was purely a verbal agreement. Now, my friend is refusing to make the payments, and I'm wondering if I have any legal recourse to enforce the repayment agreement even though it was not formalized in writing.

I'm so sorry about your situation! My name is Dolan. The answer is yes. Under California law, a breach of contract occurs when one party fails to fulfill a legal duty the contract created and causes damages for the plaintiff. (California Civil Jury Instructions Number 303.) The measure of damages is the amount that will compensate the aggrieved party for all the detriment caused thereby or likely to result therefrom. (Cal. Civ. Code § 3300.) Parties can also seek '"specific performance" of the agreement under section 3388 of the civil code. This applies regardless of whether the agreement was written or done orally. Typically, the aggrieved party is entitled to be returned to the same position they were in before the breach. Can a contractor agreement be modified without written consent?
I recently entered into a contractor agreement with a company to provide my services for a specific project, but the company has now informed me that they want to make changes to the terms of the agreement, including the scope of work and payment terms, without obtaining my written consent. I am unsure if they have the legal right to modify the agreement without my agreement and would like to understand my rights in this situation.

Without seeing the terms in question, this is a general contracts answer: 1. Does the contract itself specify how it can be modified, changed or amended? If so, the contract itself should tell you whether this is okay. 2. If the contract doesn't state how, it can usually be modified, changed or amended, if you both have "mutual" agreement to change any terms, and in writing. 3. If they are trying to change it on their side only, and it is not permitted in the original agreement, this may not be allowed and depending on the terms to be changed, and to what extent, it may be some level of breach. Again, I do not have the contract, but I understand the terms to be changed include scope and payment, which may be enough of a change from the original agreement to potentially create a new one to substitute- with your consent. Hope this helps.
