Residential Lease Agreement

California

Asked on Sep 13, 2023

Renewal clauses in a residential lease agreement?

I am a tenant in a residential lease agreement and I recently received a renewal offer from my landlord. I am concerned that the renewal clause may not be in line with state law and would like to know what rights I have as a tenant in this situation. I would like to understand more about the renewal clause and how it applies to my situation.

Sarah S.

Answered Sep 15, 2023

In California, residential rental agreements are governed by a set of laws and regulations designed to protect both landlords and tenants. One crucial aspect of these agreements is the rental renewal clause, which outlines the terms and conditions for extending a lease beyond its initial term. Understanding how rental renewal clauses work under California law is essential for both landlords and tenants to ensure a smooth and legal renting experience. The Basics of Rental Renewal Clauses A rental renewal clause is a provision in a lease agreement that dictates the terms and conditions under which a lease can be extended after its initial term expires. In California, rental renewal clauses are subject to specific regulations to protect the rights of tenants. Here are some key points to keep in mind: Written Notice: Under California law, landlords must provide tenants with written notice of their intent to renew the lease or terminate the tenancy. This notice must be provided within a specific timeframe, usually 30 to 60 days before the current lease expires, depending on the length of the tenancy. Rent Increases: If a landlord intends to increase the rent upon renewal, they must follow the state's rent control laws, which may limit the amount and frequency of rent increases. It's essential for tenants to be aware of their rights regarding rent hikes. Tenant Rights: Tenants have the right to accept or decline a lease renewal. If a tenant decides not to renew the lease, they are generally required to provide written notice within a specified timeframe, typically 30 days before the lease expires. Lease Term: Rental renewal clauses may specify the duration of the renewed lease term. Some may automatically renew for the same term as the initial lease, while others may offer options for shorter or longer renewal periods. Review the Lease Agreement: It's crucial for both landlords and tenants to carefully review their lease agreements to understand the specific terms and conditions related to renewal. Any agreed-upon terms should be clearly documented in the lease. Benefits for Landlords and Tenants Rental renewal clauses can benefit both landlords and tenants in several ways: For Landlords: Provides a mechanism for maintaining a stable and predictable rental income. Allows landlords to retain responsible and reliable tenants for extended periods. Streamlines the leasing process by avoiding frequent turnover. For Tenants: Offers the option to secure a home for an extended period without the risk of eviction. Provides an opportunity to negotiate for more favorable lease terms or rent rates. Helps maintain housing stability, especially in competitive rental markets. Conclusion In California, understanding rental renewal clauses is essential for both landlords and tenants to ensure a fair and legal renting experience. These clauses provide a framework for extending a lease beyond its initial term, but they must adhere to state laws and regulations. Whether you're a landlord or a tenant, knowing your rights and responsibilities regarding rental renewals is crucial for a harmonious and successful landlord-tenant relationship in the Golden State.

Property Lease

California

Asked on Mar 2, 2026

I have rent to own lease agreement the owner passed away and his conservator sold the property what can I do

I explained in the first box

Matthew K.

Answered Mar 3, 2026

After the sale, did you continue living there and paying the lease amount? It's difficult to expand on my answer without reading the agreement (it cannot be oral). Assuming the agreement is what you say, you might consider recording a Lis Pendens on the property. That will get everyone's attention, I can assure you. Probably also consider a quiet title action. None of that advice is necessarily relevant; it depends on what the agreement says.

You will need an attorney to advise you, as such, you will need to post your project on the website Here are the steps you need to take to accomplish this 1. Post the job you need to get accomplished – for example “ I am looking for a California attorney to assist me in the sale of my property and to help me get the county to approve the sale -------------“ 2. Once posted, attorneys on the website that are interested and qualified will respond to your posting 3. Choose an attorney/s based upon their qualifications and cover letter to have a quick call so that you can decide who you would like to hire. 4. After talking with attorneys, choose who you will decide to proceed with. Remember to discuss the cost of the project as well as how long it will take to be completed as well as when payments will be made. 5. Once you have decided who to hire, click “HIRE” and that attorney will now be hired by you. Donya Gordon, Esq.

Residential Listing Agreement

California

Asked on Oct 3, 2024

Can a seller terminate a Residential Listing Agreement before the agreed-upon period ends?

I recently entered into a Residential Listing Agreement with a real estate agent to sell my property, but I am now considering terminating the agreement before the agreed-upon period ends. The agent has not been able to generate any offers or interest in the property, and I am concerned about the lack of progress. I want to know if I have the right to terminate the agreement early and if there are any potential consequences or obligations I should be aware of.

Dolan W.

Answered Nov 1, 2024

Hello! I'm so sorry you're having to deal with this. Legally speaking, most real estate agent agreements generally state you must pay their commissions even if you terminate the relationship, typically up to 6 months after the termination of the relationship. In theory, you have a breach of contract action if this person has not done any actual work or generated any offers or any interest in the property. This would likely make the agreement "unconscionable" in this case. So what does this mean? It means your best option is to negotiate the termination How do you do that? One little-known, but very effective tool that lawyers use to settle matters outside of court is called principled negotiation.  All this means is that you are looking to get something done on the basis of principles, even if you can’t find a law to support you.  It takes the anxiety out of dealing with the other side because you’re focused on the facts, not each other.  With that said, here are some simple steps you can follow: Figure out what the other side’s interests are (saving money, saving time, etc.?); Think about what your interests are (saving money, saving time, etc.?); Come up with 2 to 3 reasonable and objective ways to solve the problem; Present it to the other side; If the other side rejects, ask them, “Is there a reason why you do not feel it is necessary to negotiate?” Consider what your best alternative to a negotiated agreement is.  This will give you confidence that no matter what, you'll have an option. Of course, these are just building blocks to get the other party to help solve the dispute.  Believe me when I say that good lawyers use this technique all the time to keep things out of court.  You’ll find that it is very effective even with the most stubborn of individuals. Best of luck! Dolan

Commercial Building Lease

California

Asked on Mar 21, 2023

What's CAM charge in a commercial lease?

I am currently negotiating a commercial lease for a property where I plan to operate my business. As part of the negotiation process, the landlord has mentioned the concept of a CAM (Common Area Maintenance) charge, which I am unfamiliar with. I would like to seek the advice of a lawyer to better understand what a CAM charge is, what it covers, and what my responsibilities as a tenant would be in relation to this charge.

Paul S.

Answered Mar 21, 2023

CAM charges are for common area maintenance. For example, in an office building, CAM charges are for maintaining the lobby, elevators, corridors, and outside areas (such as the parking lot). If you are looking at renting a space, the landlord should be able to provide you with CAM numbers for that space for the past several years, so you know what to expect.
