Both of my parents passed away within four weeks of each other, and what started as a straightforward summary administration became significantly more complicated when an $80,000 life insurance policy was discovered after the initial court order had already been entered. I needed to vacate the summary administration, open formal administration, and file a separate petition for my father's estate — six court documents total, plus supporting filings. I had been quoted $3,000 by other attorneys for this work. Gill reviewed everything for $250. But the price only tells part of the story. Gill turned the entire review around in a single day. I recently left my job of five years and have been offered a new position with a competitor. The new employer has asked me to sign a noncompete agreement. I am concerned about the geographic scope of the agreement and need to understand what areas it would cover, and if it would prevent me from taking a position with a competitor in another state or country.

The Courts use a reasonableness standard determine if a non-compete is reasonable in time and geographic scope. It would be necessary to see the non-compete to tell you what it says, the areas it would cover and if it would prevent you from taking another position.

How are damages outlined in a settlement agreement?

I recently reached a settlement agreement with a former employer in a dispute over unpaid wages. The settlement agreement outlines that I am to receive a certain amount of money as damages, however, I am unclear on how these damages were calculated and if there are any additional costs or fees associated with the settlement agreement. I am hoping to find out more information on how the damages were determined so that I can make sure I am receiving a fair settlement.

Your questions are certainly valid and you are entitled to answers. And you should receive the information before you sign a settlement agreement. Some of the terms of which should be included in the settlement agreement, such as if there are any other fees or costs associated with the settlement.

The National Labor Relations Act prohibits an employer from engaging in retaliation against two (2) or more employees who band together to for mutual aid and protection, including raising concerns about lack of pay details. Florida Whistleblower Act, Fla.
