What's permitted use in a commercial lease?
I am in the process of negotiating a commercial lease for my business and I am interested in understanding the concept of "permitted use." Specifically, I am curious about what activities are allowed in the leased space and what limitations there may be. I would like to consult with a lawyer to ensure that the terms of the lease align with the needs of my business and that I am not at risk of violating any provisions.

Permitted use means that you can only use it for the reason you rented it. For example, you cannot rent a place to use as a gym but then use it for a nightclub.

What is the best type of commercial lease?
I am a landlord and am wanting to consider which types of commercial lease agreements I would want to use. I own a small strip mall and am looking to sign tenants that would be retailers.

Much of that depends on the tenant and the agreement they are willing to enter into. Personally, I would want my tenants responsible for as much of the maintenance and upkeep of the property as possible. The same goes with the property taxes. You could calculate out what property taxes are / would be per square foot and allocate to them which will permit you to adjust rent annually to accomodate changes in the property taxes.

I recently signed a net lease agreement for a commercial property, and I am unsure about the extent of my responsibilities as a tenant when it comes to maintenance and repairs. The lease states that I am responsible for all operating expenses, but I want to clarify if this includes regular maintenance and repairs, or if those obligations fall on the landlord. I want to understand my rights and obligations before I proceed with any costly repairs or maintenance tasks.

Such responsibilities will probably include some maintenance and repairs while the landlord is likely responsible for structural soundness, essential services and common area maintenance of the property. Can the tenant make alterations to the property?
I am a tenant of a commercial property and I am interested in making some alterations to the property. I understand that I will need the landlord's permission to make these changes, but I am unsure of what the landlord's policy is regarding tenant alterations and what the legal implications of making such changes might be. I am looking for clarification on the tenant's rights and obligations when making alterations to a commercial lease agreement.

Hello! There should be an alterations clause in your lease that speaks to what is or isn't allowed in your space. Your safest bet is to have your landlord review and sign a letter of consent for more substantial improvements (beyond paint, mounting items, etc.)
