Can my employer legally implement a policy that requires employees to work overtime without additional compensation?

I have been working for a small tech startup for the past year, and recently my employer announced a new policy stating that all employees are required to work a minimum of 10 hours of overtime each week without any additional compensation. This policy was implemented without any prior notice or agreement from the employees, and it has caused significant disruption to our work-life balance. I am concerned about the legality of this policy and whether my employer has the right to impose such requirements without providing any extra compensation.

I understand your concern about this new overtime policy. This situation raises significant legal questions under federal labor laws, particularly the Fair Labor Standards Act (FLSA). Under the FLSA, non-exempt employees must receive overtime pay at a rate of not less than 1.5 times their regular rate for hours worked beyond 40 in a workweek. However, the classification of employees as exempt or non-exempt is complex and depends on various factors, including job duties and salary level. The Department of Labor (DOL) is the federal agency responsible for enforcing the FLSA. They investigate wage and hour violations and can take action against employers who violate these laws. Key points to consider: 1. Your exempt/non-exempt status 2. The specific terms of your employment agreement 3. Any state laws that may provide additional protections (Most states follow the federal 40-hour workweek threshold for overtime but a few have higher weekly thresholds.) I worked for a start up with a promised to pay a specified amount for my services backed by emails and documentation. The company is growing with 8 + employees but communication on when I will be paid has basically stopped. They now have 8 plus employees. Suggestions on how to get payment? I am in Washington State company is in Virginia

My suggestion is to request an employment agreement that outlines your role, responsibility and payment. If that doesn't work, draft your own agreement and ask them to sign your document.
