Is my non-compete enforceable?
If a small company made you a verbal offer of salary, car, health insurance assistance then after you signed the employment agreement, including non compete, made excuses and never made good on the car and the insurance assistance, is the non compete enforceable. I singed based on promises of a partnership and those additional perks since they didn't provide any other benefits. I turned down other opportunities because of the partnership potential and brought my own equipment and opportunity. Now after providing new business opportunity I asked for some protection in writing regarding partnership in the new technology, mainly developed by me and partly carried over from previous experience. Instead of getting the promised protection in writing I got fired. I know that it isn't in writing because of excuses but I also know they would never lie under oath. They are many things but they wouldn't do that for very religeous reasons. The non compete is onerous and those perks were to sweeten the deal so I would sign. I even met with their attorney to complain about it before signing based on their promises which then never materialized and were not provided in writing.

I suggest you seek an employment attorney in your area to discuss. If they are so religious, what happened to you should not have. An agreement for the partnership need to be in writing to be enforceable. If you signed an employment agreement, then you should have signed something when you were leaving. Can I create a contract that bars any form of dispute resolution (Jury trial and Mediation/Arbitration) if a client fails to dispute an invoice within 7 days of receipt.
I own a growing security guard firm and all my clients sign a service contract before we provide services. In order to reduce the stress of collecting from a slow playing client, I want to create a new contract that makes it impossible to dispute an invoice after 7 days of receipt.

While you may create a contract without dispute resolution, the issue is whether it would be enforceable by any court. Seeing that a contract is between two parties and disputes arise, by barring any resolution, it would essentially not afford a party an opportunity to be heard. What is my best path to recover a down payment paid to a contractor who never started my job and has gone MIA while I've been trying to cordially recover my money. Demand Letter via certified mail etc..?
I signed a contract with a contractor to update my home. I signed the contract and paid a $5k deposit (the contract has zero verbiage related to a deposit) to 'get on his list'. After several months and failed attempts to get a specific start date I informed the contractor I was not going to move forward with the project. He said he would pay the deposit back but asked for me to accept $1000 / month. He paid $1000 back however has gone MIA since and is not returning any calls or texts.

I suggest you have an attorney send a demand letter. If that fails, you can bring you claim against the contractor to small claims court.

In 2020 during covid my business was forced to shut down. I was also working, I had a job and I owned an event planning business. before filing for UI I called in to ensure I was able to file for the PUA for my business. I was told by the representative yes I can. in her words she said "anyone can apply for the PUA" she did not explained to me that I cannot apply if I had another job, or what the conditions were, as I have never filed for or been on unemployment in my life until covid happened. In september 2022 I received a letter stating that I was overpaid benefits in the amount of $62000. I filed for a weaver which I was not qualified for, then I appealed and the judge ordered a recalculation and that amount went from $62K to $58K. I cannot pay this money and I need help in fighting that this was not my fault. My taxes will be garnished every year until this is paid off. I am hoping someone out there can be of assistance to me, I really need it.

Hello, I am sorry for the mix up. I worked with a client last year with similar circumstances. She was overpaid as well. We had a hearing and it was determined, since she had never filed before and English is not her first language that she had not done it intentionally so that fine on the payment was removed. That being said, if you were overpaid, you will need to repay the amount. She signed up on a payment plan. I suggest you do the same. The recourse you would have is based in your agreement. Would her actions constitute a breach/breaking of the covenants of the original agreement? If so, then your agreement should also lay out the consequences of such breach.
