I am in the process of creating my will and estate plan, and I am considering designating a close friend as the executor instead of a family member. My family dynamics are complicated, and I do not have a strong relationship with any of my relatives. Can I create an estate plan without the help of a lawyer?
I am in my mid-fifties and have recently been diagnosed with a terminal illness. I have a large estate that I would like to be distributed to my family and friends when I pass away. I have done some research and understand the importance of having an estate plan, but I am not sure if I am able to create one without the help of a lawyer. I am looking for more information that will help me make the best decision for my family and myself.

You can certainly go ahead and fill out simple forms to complete some easy estate planning documents like wills, but for more complicated documents like a trust (which is required if you want to avoid probate) it can get a little trickier. Further, anyone can fill in the blanks, but an experienced attorney will be able to explain what the document does and how it meets your wishes best. Hope this helps.

How can I set up a trust to protect my assets?
I am a business owner and have accumulated significant assets over the years. With the increasing risks and uncertainties in the business world, I am concerned about protecting my assets from potential lawsuits, creditors, and other unforeseen circumstances. I have heard that setting up a trust can provide a level of asset protection, but I am unsure about the process and the different types of trusts available. I would like to consult with a lawyer to understand how I can establish a trust that safeguards my assets while still allowing me to have control and access to them.

There are numerous forms of Trust that are available depending on the specific assets and your unique goals. Generally speaking, the two main types of trusts are Revocable and Irrevocable. WIth a Revocable Trust, just like it sounds, as trustee you can remove the assets at some point if you so chose, but if you are to pass away or become incapacitated at some point, it reverts to being Irrevocable. An Irrevocable Trust is one in which the grantor transfers all ownership interests to the Trust itself and this act is irreversible. As I am sure you guessed, there are a myriad of ways that your goals can be achieved and I would be happy to provide a free consultation to discuss your situation and possible solutions.

Can someone who has POA & is a caretaker of a family member in an assisted living facility receive compensation for services rendered from the family member’s estate?
I have a cousin that has taken on sole responsibility for the care of my aunt (95 yrs old), who is now in an assisted living facility. He has spent countless hours handling the sell of her house, enrolling her into an assisted living facility, daily visits, taking her to doctor’s visits and handling any issues that may arise. Family members of my aunt would like to compensate my cousin for all his time spent in caring for my aunt. Can my cousin be paid a monthly compensation from my aunt’s estate? Can each family member sign a statement (and have it notarized) that they are in agreement for this money to be paid monthly to our cousin for his services? What steps would we need to take to make this happen? We just want to make sure it is all done legally.

I would say yes, especially if it is in the power of attorney that they can be compensated. If you want to reduce that down to a payment agreement, you can; it may not be necessary, but you can definitely do that. I would start with the durable power of attorney first!
