Can a trust be contested after the death of the person who created it?

Can a trust be contested after the death of the person who created it? I recently discovered that my late grandmother had created a trust before her passing, and I am concerned about its validity and the distribution of assets. There are certain family members who were excluded from the trust, and I suspect they may try to contest it now that my grandmother is no longer alive. I want to understand my rights and options in case a dispute arises regarding the trust.

You will need to review the Trust Agreement carefully. A Trust usually cannot be contested after the grantor dies. If the trust agreement was drafted correctly, it appoints a successor trustee to take over the trust and the trust assets. In other words, the trust continues to operate.

Hi. I'm not sure I understand your question. Everyone should have a will regardless of whether you have a trust. The question is whether you need a trust. A lot of that has to do with avoiding probate or some other potential uses depending on the goals and needs. But a typical family would use a trust to better organize everything and control distribution while avoiding going through the court process called probate.

You don't necessarily need a POA to move him to another state if he is agreeing to move. But at some point you'll need a POA (if he has the capacity to sign one) or to become his guardian.

How can I set up a trust to protect my assets?

There are numerous forms of Trust that are available depending on the specific assets and your unique goals. Generally speaking, the two main types of trusts are Revocable and Irrevocable. WIth a Revocable Trust, just like it sounds, as trustee you can remove the assets at some point if you so chose, but if you are to pass away or become incapacitated at some point, it reverts to being Irrevocable. An Irrevocable Trust is one in which the grantor transfers all ownership interests to the Trust itself and this act is irreversible. Generally, if a person is competent, he or she can revoke a power of attorney at any time and execute a new one in favor of someone else. Every individual/business that is aware of the previous power of attorney will need to be notified that it has been revoked and given the updated power of attorney. However, if a person has any conditions that may be impairing mental functions, it may be necessary to petition the court for guardianship/conservatorship. Both of these scenarios can get complicated incredibly fast, and you should consult with a lawyer in either situation.
