I suggest you consult with an attorney who handles commercial real estate transactions. I suggest you as what charges you will be responsible for - water, heat, electric; what alterations are allowed; what repairs will the landlord cover; if the landlord will abate rent for COVID shutdowns.

I am in the process of purchasing a rental property that currently has tenants living in it. I am looking to have a Purchase and Sale Agreement drawn up, however, I am uncertain of my rights and responsibilities as the new owner of the property with regards to the existing tenants. I would like to know what the agreement should include regarding the tenants and my obligations as the new owner.

hello, i am looking to purchase a vacant city lot in savannah, georgia. it was taken by the city for taxes in 1968 and sold to the current buyers in 1986. seller will only give a quitclaim deed. once i purchase the lot what is the process and cost to get title insurance? regards paul

Paul, Please, please, please purchase the title insurance before purchasing the lot (if possible). This will protect you in the event of any title defects. It is normal for the owner of a lot to prefer to transfer the property via quitclaim deed, especially if the property was obtained via a tax sale. However, it may be extremely helpful to determine, in advance, if there are any title defects which need to be addressed. Are you under contract to sell the property? Can the seller of a commercial property back out of a purchase contract after signing it?
I am in the process of purchasing a commercial property and have signed a purchase contract with the seller. However, the seller has recently expressed doubts about selling the property and has hinted at the possibility of backing out of the contract. I have already invested time and resources into the due diligence process and securing financing, and I am concerned about the potential consequences if the seller decides not to proceed with the sale. I would like to know if the seller has the legal right to back out of the contract after signing it, and if so, what recourse do I have in such a situation?

Generally, the seller cannot legally back out of a properly executed purchase agreement where both parties have signed and acceptance has been communicated. Texas courts have consistently held that unilateral rescission by the seller is not permissible without proper cause and procedure, and attempting to do so would constitute a breach of contract subject to legal remedies. The contract itself may include the penalties for the seller failing to follow through on the sale. You, as the buyer, have multiple avenues for relief, including specific performance, termination and recovery of earnest money, and monetary damages, depending on the circumstances of the breach and the terms of the contract.

Can a seller back out of a Lease Purchase Agreement without providing a reason?
I entered into a Lease Purchase Agreement with a seller for a property, where I agreed to lease the property for a certain period with the option to purchase it at the end of the lease term. However, the seller recently informed me that they have decided not to proceed with the agreement and are backing out, without providing any specific reason for their decision. I had already invested time and money into preparing for the purchase, and I am now concerned about my rights and options in this situation. Can the seller legally back out of the Lease Purchase Agreement without giving a reason, and what recourse do I have?

Quite simply, the answer depends on exactly what the LPA States either party will or will not do. Ordinarily termination or cancellation rights are expressly spelled out in contracts. This is why it is so important to have an attorney work on your documents rather than just using canned documents available on the Internet.
