You would be wise to request that an attorney review the proposed employment agreement before you sign. In addition to ensuring that you would have voting rights, there are numerous other terms that should be carefully reviewed, such as non-compete language if and when you leave employment; TRAP language (usually requiring an employee to reimburse the employer if the employee receives training during his or her employment); terms and conditions of employment (such as schedule, work type, and duties); vacation hours; how disputes will be resolved; and, sometimes, future severance.

Employment handbook employee privacy policy?

I recently started a new job and my employer provided me with an Employment Handbook. I have read through the handbook and noticed that there is not a section on employee privacy policies. I'm concerned that the lack of an employee privacy policy could leave me vulnerable to having my personal information shared without my knowledge or consent. I am interested to learn what kind of legal protections I may have in this situation.

There are numerous state and Federal laws governing your privacy, HIPAA being a notable example, so even if your employer had no handbook at all, your employer would still be subject to all these laws.

Generally, in Florida, severance is a gift. $1 of severance is usually $1 more than an employer is obligated to provide. An offer of severance may be required if an employee has an employment agreement providing for severance or is otherwise subject to a collective bargaining agreement that provides for severance. Severance agreements that are only offered to certain employees in a discriminatory manner (such as based on age, religion, national origin, sex, etc) may be a violation of local, state and/or federal law.

The National Labor Relations Act prohibits an employer from engaging in retaliation against two (2) or more employees who band together to for mutual aid and protection, including raising concerns about lack of pay details. See link here: https://www.nlrb.gov/about-nlrb/rights-we-protect/the-law/interfering-with-employee-rights-section-7-8a1 If the company has failed to compensate employees for work, it may be a violation of the Fair Labor Standards Act (FLSA) and/or the Florida Minimum Wage Act (if the employer and employee meet coverage requirements). Florida Whistleblower Act, Fla. My employer has placed me in a position thru another vendor. My employer contract with that vendor is ending. So vendor contacted me. However I am in contract with my employer for 1 year contract.

Short answer: Probably no, non-compete and non-solicitation clauses are not usually enforceable on an employee in California. Long Answer: Regardless of the choice of law provision in your contract, if an enforcement action is brought against you in California, the California courts will dismiss it as it goes against the "public policy of the state" unless your employer can make a really compelling case. Most states respect the stated public policy of other states when deciding matters against their citizens, so even if the case was brought in another states courts your soon to be former employer would probably be powerless to get a judgement enforcing your non-compete.
