Can I trademark a phrase that includes a common word?

I am in the process of starting a small business selling handmade jewelry, and I have come up with a catchy phrase that I want to use as my brand name. However, the phrase includes a word that is commonly used in the industry. I am unsure if I can successfully trademark this phrase, as I have heard that trademarks cannot be registered for generic or descriptive terms. I would like to know if it is possible to trademark this phrase and what steps I need to take to ensure the best chance of success in the trademark application process.

In some situations, I also handle matters throughout New York State. If your phrase contains common jewelry terms, registering it may be challenging. One suggestion is to check the USPTO Database for similar trademarks. If other businesses have brands using the same common word in their brand name, that could give an indication that you may still be able to use it in your brand name. Nonexclusive use means that the word or phrase can be used by other parties and is not solely owned or controlled by the trademark holder. Consult with a trademark attorney for guidance on the registration process and the viability of your chosen phrase.

Yes, you can achieve this through an IP license agreement versus a sale of your IP rights. In your license you would want to protect against gray market product manufacturing and also have provisions on how to handle defective products and components during the manufacturing process. Without seeing the handbook it would be difficult to answer your question. Generally, what an employee creates for the Company is Company property, unless you have an agreement with them that states otherwise. It would also be helpful to know if you are an employee or independent contractor. Sometimes Company's give employee handbooks to independent contractors but the classification of whether you are an employee or independent contractor is important to this analysis.

When you're reviewing a Developer Agreement, it’s really important to make sure it covers the basics while also protecting your rights and interests. Here’s a breakdown of what you should look out for in plain terms: Hello! My name is Dolan and I am happy to help. First off, the agreement should clearly describe the scope of work (often called the "SOW") This means it needs to explain exactly what you're expected to do, including the features or functionality of the app, the timeline for delivery, and any milestones. Make it specific. It has to be clear what is defined as intellectual property and then who owns it. Compensation is another big one. The agreement should spell out how much you’re being paid, whether it’s a flat fee, hourly rate, or based on milestones. I Confidentiality clauses are pretty standard, but you’ll want to make sure they don’t go overboard. Termination clauses are also super important. These should say under what conditions either of you can end the agreement. Make sure that if the company decides to end things early, you’ll still get paid for the work you’ve done up to that point. I have been operating a ministry for helping prisoners that are released by way of podcast, but now we are growing and want to provide hygiene and other assistance for them as well.
