When it comes to subleasing an apartment or rental, do I need specific written permission from the owner, or as long as the lease agreement doesnt forbit it, am I okay to proceed?

I am in the process of potentially leasing a home in Savannah, GA for a period of 8 months. My goal is to sublease this home as an Airbnb and make a profit. The leasing agreement has no language forbidding subleasing the property, but it also doesnt have express written permission either. I'm just wondering if that means I can proceed with my plan.

This is a topic I get asked about very frequently. In Georgia, the right to sublet residential property is based on the express (written) and implied (inferred) language of the lease. Generally, if subleasing is not mentioned, then there is no restriction on subletting. In any event, you may want to at least have a discussion with your Landlord concerning what you plan to do. This can avoid lots of headaches for you and your guests later down the line. Acceptance of residential Real Estate Offer in Pennsylvania

Selling Agent told our Buyers Agent (i am buyer) that there was another buyer, that they would do highest & best / Best and Final offers by Sat NOON time. We provided our best and final offer by Sat at NOON. Sunday approx. 3PM the sellers agent told our buyers agent that the sellers have selected your buyers offer, it was due to removing the inspection contingency and being within 5K of the other bidder, we were very excited. We do not have a conter-signed PA real estate contract, we have an email note from the seller's agent representing the seller to our buyers agent indicating the the seller has accepted your buyers offer. My Question: the acceptance was in writing (email) and signed by sender of email - Sellers agent, specifically indicating they accepted our offer which was signed and in writing. Subsequently the sellers agent indicated when they did not sign our offer, that since they had not signed and had not signed the specific contract, that they were accepting a 2nd offer at a higher price. Any hope of wining based on the acceptance of our offer was first, it was in writing (email) and signed by sellers agent?

The agent’s email will not be enough. You will need the agreement signed by the sellers, as they are the contracting party.

Depending on the land and business, I'd consider making an LLC for asset protection reasons. Then you could have a trust as the member. If you need to get the property out of your estate, this will dictate what to do with the trust.

seller is a divorced man whose ex lives across street. She turned him in for not permitting a deck. Court applied restraining orders on both. seller had plans drawn and submitted but pandemic hit, He is in financial crisis and has a buyer for home whose bank has agreed to lend . seller has paid all violation fees but county is slow in helping him. he is evacuated from Caldor fire with his other home. Seller needs to due a subordination and let sale happen while county reviews his plans and inspects. Is there anything else he can do? California ..e

code violation paid in full but County is not open and working from home. have not been able to handle this issue in timely manner has been 2 1/2 yrs since first submitted drawings . he is not permitted to go in the area due to a nasty divorce and wife living across street..he also is diabetic and has been hospitalized and needs medicine not covered by insurance
