Project Description

In 2021, a personal client in Pennsylvania sought assistance with preparing and filing an affidavit of heirship after discovering funds remaining in a deceased family member's pension account. The client needed this documentation to facilitate the distribution of the funds among the surviving children, as there were no other heirs or debts to consider. With the pension account controlled by a financial institution, the process was straightforward but required formal legal documentation. As a result, the client received two proposals from licensed attorneys, with flat fee bids ranging from $450 to $1,500. Each proposal was submitted promptly to meet the client's requested deadline of one week.

What are inheritance rights for niece and nephew?

My Aunt passed away July 9, 2021 and she had a will. On the will she stated that she wants everything left to my mother whom is deceased as well and executer of estate is my sister.

Does the will have a provision that states who will receive your aunt's assets if your mother predeceased her? If not, I believe the rules of inheritance found in the New York Statute will govern. https://www.nysenate.gov/legislation/laws/EPT/4-1.1. Your sister needs to go to the Probate Court and/or consult an estate attorney.
