Project Description

In 2026, a business in Tennessee sought assistance with an employee separation agreement due to concerns about the legitimacy of a recent reduction in force (RIF) that they believed was retaliatory. The client had encountered a troubling pattern of conduct over the previous years, which included receiving vague feedback, being denied professional development opportunities, and ultimately being isolated from colleagues. After raising these issues with HR, the client found that their situation worsened, leading to the decision to terminate their role despite the client being qualified for available positions within the company. As a result, the client received nine proposals from licensed lawyers, with flat fee bids ranging from $495 to $2,000, all submitted to address their needs within the requested deadline of less than one week

Employee Separation Agreement

Asked on Mar 12, 2025

Can an employee be forced to sign a separation agreement that includes non-compete clauses?

I recently received a separation agreement from my employer, which includes non-compete clauses that restrict me from working in the same industry for a certain period of time. I am concerned about the potential impact on my career prospects and wonder if I can be legally compelled to sign such an agreement.

Forced? No. Can they condition signature to receiving some form of severance? Yes. Can they condition it to receive a final paycheck of money earned? No. Can they include a non-compete in a separation agreement? Yes… but California has VERY employee-friendly laws related to non-competes. The specifics of the presented language in the agreement will matter and should be reviewed by competent counsel in your jurisdiction.
