Project Description

In 2026, a California-based business specializing in eyewear distribution sought assistance with drafting an employee separation agreement for a North Carolina-based employee whose position was set to be eliminated. The client needed the agreement to comply with North Carolina regulations while also incorporating specific provisions such as general release of claims, confidentiality, and non-disparagement clauses. They provided an existing California separation agreement as a starting point and aimed for a practical, business-oriented solution rather than litigation assistance. As a result, the client received four proposals from experienced attorneys, with flat fee bids ranging from $650 to $2,000. All proposals were submitted to meet the client's requested deadline of one week, ensuring a timely resolution to their needs.

Employee Separation Agreement

California

Asked on Mar 12, 2025

Can an employee be forced to sign a separation agreement that includes non-compete clauses?

I recently received a separation agreement from my employer, which includes non-compete clauses that restrict me from working in the same industry for a certain period of time. I am concerned about the potential impact on my career prospects and wonder if I can be legally compelled to sign such an agreement.

Forced? No. Can they condition signature to receiving some form of severance? Yes. Can they condition it to receive a final paycheck of money earned? No. Can they include a non-compete in a separation agreement? Yes… but California has VERY employee-friendly laws related to non-competes. The specifics of the presented language in the agreement will matter and should be reviewed by competent counsel in your jurisdiction.
