Can a Deed of Trust be modified without the consent of all parties involved?

I recently purchased a property with the help of a mortgage loan, and a Deed of Trust was executed to secure the loan. However, I have come across some financial difficulties and am considering refinancing the mortgage to lower my monthly payments. I have been informed that the terms of the Deed of Trust may need to be modified in order for the refinancing to take place, but I am unsure whether all parties involved, including the lender and the trustee, need to provide their consent for such modifications to be made. Can a Deed of Trust be modified without the consent of all parties involved, or do I need to obtain their approval before proceeding with refinancing?

You must have their consent. In the general/miscellaneous provisions toward the bottom of the DOT, you should see a standard provision, stating that no amendment to the deed of trust will be valid unless evidenced by a fully executed written agreement.

I am looking for a Warranty Deed for the sale of property in St. Croix, USVI. All forms I locate are specific to one of the US 50 states.

State listed below as my state is not relevant ... I need a Warranty Deed form or written up for USVI property.

What questions should I ask for a commercial lease?

I am being asked to sign a commercial lease agreement and am interested to learn what types of questions I would want to ask the landlord before signing the agreement. Any thought or advice would be much appreciated!

I suggest you consult with an attorney who handles commercial real estate transactions. I suggest you as what charges you will be responsible for - water, heat, electric; what alterations are allowed; what repairs will the landlord cover; if the landlord will abate rent for COVID shutdowns.

What are the laws for subletting a bedroom in 2 bhk appartment without landlord consent in Illinois?

I wanted to sublet my apartment without landlord consent, since my lease with this landlord doesn't allow sublease, May I know if there is any possible way to make this bedroom sublet without landlord agreement. My city is Peoria, Illinois

If your lease doesn't allow a sublease, you can't do it. I'd just approach the landlord and see what could be done. If the person moving in would be willing to sign a one-year lease and do the typical background check, the landlord may let you out of your lease.

what is better to buy land or rent for construction in US?

I suppose it doesn't matter if you have the lease giving you permission and the lease is long enough to justify the building expense when you won't own it. But I'd buy the land so you could eventually sell the property with the building on it.

Warranty Deed

CAN YOU TELL ME THE PROCEDURES OF A WARRANTY DEED

I RECIEVED A WARRANTY DEED IN THE MAIL AFTER THE SELLERS REFUSED TO SPEAK TO ME AFTER A FIRE OCCURED LAST YEAR

T. Phillip B.

Answered Jul 12, 2022

Did you purchase the property before or after the fire? If before, did you have insurance? If after, what was the agreement you had with respect to the insurance proceeds the Seller was to receive? The Warranty Deed is what is offered when there is a transfer of real estate and the seller warrants ownership to another. Frequently this will also involve title insurance to back up the warranty deed if there were other claims against the property
