I sold my house but was never paid

To avoid foreclosure, I spoke with a contractor to flip my house for me. He would pay my mortgage until it sold then pay it off and keep the profit. I walk away with the mortgage company paid, but I was fouled. He isn't paying the mortgage after I signed the contract. I'm concerned he will be able to sell it now himself without the mortgage company ever being paid.

There are many issues involved in this question. I would need to see the original deed and mortgage on your house plus the contract you signed with the contractor. The original mortgage almost certainly had an acceleration clause stating that if you sold the property, then the full mortgage becomes due. Going after the contractor might be possible but other avenues would more likely be the better route to keep your house from being foreclosed. Will also need to see if your contract gives ownership to the contractor or just the right to sell on your behalf. Lots of additional questions that need documents to give you your options.

How to determine jurisdiction for lawsuit?

I have a promissory note written in Montana that was breached. I am in New York. I am the borrower and my aunt is the lender; I have since discovered she wrote the note with unfair terms. I need the note voided. What do I do? I can’t find an attorney anywhere to take my case.

Hi - what does the contract say? We are looking for the choice of law clause. If the contract provides for NY choice of law then fantastic! You hire an attorney in New York, send them a demand letter and file in a New York State Court - on the day after the expiration date for your letter. Once you get your judgment in New York, you hire a collections attorney in Montana to go collect your judgement (if they won't pay up - its amazing how much they are willing to pay when you get a local lawyer to put a lien on their house!) If the choice of law clause says Montana - you can (i) be certain and hire a lawyer in Montana and follow the same process or (ii) be aggressive, hire and file in New York, just to ensure that they have to hire a New York lawyer to get the case dismissed. The second situation would be if you think they would rather settle with you than pay someone in New York to get the case dismissed. There is a lot of strategy to consider - but the most important thing in any of this is to be decisive and move forward with a lawyer quickly once you decide on a course of action. I've seen clients who had stronger cases lose in the end because the other side was aggressive in Court and had their lawyer on a retainer immediately and filed before my client could finish "considering her options."

Chattel mortgage lease purchase in a cooperation

Solicited agent high pressure sales, gave me one piece of paper that I believe is a promissory note. No prospectus or lease. Owner/seller harassing me to voluntarily break lease. All payments are current. Owner knows I suspect fraud and is retaliating. I went to the DA 14 days into this without enough evidence, they said to talk to property managers. All property managers ignored my requests and canceled a meeting. I have been trying to get help for months. I recently had a 101 inspection done adding some extras and the property is in worse condition than I even imagined. I have online advertising screenshots of all the ads that were deceiving and misleading. I had no idea that I was getting into a REIT. This is absolutely 100% fraud. Investment scam. It's so complicated, it took me 7 months of researching relentlessly to see what these people did to me.

You are on the right in getting the DA involved. However, your issue is very specific and you need someone with experience and expertise to assist you going further. Are emails legally binding?

My ex-husband and I discussed getting my son a cell phone, but he was very much against it. We came to an agreement that we would not get him one until the end of the school year, but my current husband bought him one. I am wondering if the email that was written is legally binding. I would like my son to still be able to use the phone, even though my exhusband is still against it, but wanted to make sure the agreement that was made wasn't legally binding.

Early in law school we learned that any bargain for consideration can be legally binding, meaning anything even written on a cocktail napkin can be binding if it contains the elements necessary to deem it a contract. Although I am answering this as a hypothetical and not as your attorney it is very possible for an agreement to be deemed legally binding when done via email if it can meet the threshold of being a contract. The basic elements for a contract or legally binding agreement are offer and acceptance, adequate consideration, capacity and legality of the contract. If an email contains all those elements it can be an agreement that was made through the course of the communication. Booking Contract Dispute - Who has jurisdiction?

I recently booked a property rental through VRBO. I left a review of the property and now the property owner is threatening legal action if I don't take down my review. The property is in Turks & Caicos, the property owner resides in Canada and I live in the United States. What country has legal jurisdiction and who/where would I go to seek legal counsel?

You should go to VRBO terms and conditions. The document should list where disputes should be held. Since both you and the owner are users of the site, you are both bound by the terms.
