What is an Assumption Of Risk Agreement?
An assumption of risk agreement is a term used to describe the legal doctine that bars plaintiffs from making legal claims resulting from self-exposed danger. For example, if a plaintiff sustains an injury after engaging in knowingly hazardous behavior, they are not able to recover legal damages resulting from the hazardous behavior. This protects defense teams from being held liable for a plaintiff's bad decision-making.
The purpose of an assumption of risk agreement is to ensure that plaintiffs can't knowingly put themselves in harms way in order to recover legal damages as a result.
