What is a Temporary Guardianship Agreement?
A temporary guardianship agreement is an agreement that documents the transfer of physical custody of a minor to a guardian temporarily. Temporary guardianship agreements do not require judge approval, so they can take effect immediately upon filing at a courthouse. If there is no provision in this agreement that there will be a shorter or longer term agreement, the agreement will automatically expire after six months.
In order for a temporary guardianship agreement to be effective without a judge's approval, the proposed guardianship must last no longer than six months, must have approval from the minor's parents or legal guardian, and the document must be signed and notarized.
