EB2 Visa Processing Time

This page explains eb2 visa processing time, how to expedite it, and how to consult with a lawyer from ContractsCounsel for assistance.

Jump to Section

EB2 visa processing time refers to the length that US officers spend on examining and deciding about applications for immigration through an EB2 visa. Different aspects like the country of origin of the applicant, the particular visa type within EB2 classification, and how busy USCIS is at present can affect it. Let us see more details on this.

Steps to Understand EB2 Visa Processing Time

Each step takes a certain number of days to process, thus affecting the total number of days taken to process an EB2 visa application.

  1. Complete PERM Labor Certification. This is the first stage in the EB2 visa process, which refers to PERM labor certification. The total time taken to complete this certification process is approximately 10 months. The employer performs this vital step once they identify a foreign national they want to engage. At this point, the employer cooperates with the Department of Labor (DOL) so that no worker fills that position. Typically, these processes entail requesting prevailing wage determination, recruitment efforts, and submission of PERM labor certification application (Form ETA-9089). Within 180 days of starting the recruitment effort, submit the PERM labor certification application. The DOL takes about six months to adjudicate the case; however, if audited, it may take longer.
  2. File Immigrant Petition. The second step is filing an immigrant petition, usually done by a U.S. employer. It usually takes between 6-9 months under normal circumstances, while premium processing takes around 15 days but is not available for national interest waiver applications; it involves filing Form I-140 with USCIS.
  3. Obtain Priority Date. When applicants file their immigrant petitions for EB2 visas ( Form I-140), they get a priority date provided by USCIS, which determines when they can adjust their status or apply for a green card. The wait times vary always based on the individual’s country of birth, ranging from immediate scheduling to several years of waiting (0 to 10+ years).
  4. Apply for Visa Application or Adjustment of Status. The final stage allows the foreign beneficiary to apply for an immigrant visa at an embassy abroad. If already in the United States, they can file for an adjustment of status within one year from the priority date. To reach this stage, individuals need medical examinations and thorough document preparations. The average processing time for either option is approximately nine months.
  5. Expedite Processing with Concurrent Filing. For people with a current priority date and lawful presence in the U.S., they may concurrently file their Form I-485 application for adjustment of status along with their immigrant petition on Form I-140; this helps in shortening the overall processing timeline to about 9 months.

Ways to Expedite EB2 Visa Processing Time

The process of applying for an E-2 visa can be long, but there are ways to shorten it. Knowing these options will help people who want E-2 visas save time, which they can use doing other things. Here, we look at three main ways to speed up the process of getting an E-2 visa.

  • National Interest Waiver: The E2 visa process may be quickened for those who meet National Interest Waiver (NIW) category eligibility requirements. In this regard, NIW applicants are not subjected to PERM labor certification, which saves them about 10 months of the waiting period. If you want to file for an EB-2 national interest waiver, contact an immigration lawyer, but bear in mind that there is no premium processing option available for national interest waiver EB2 filings.
  • Premium Processing: Premium processing is a service given to applicants to significantly reduce the amount of time taken during EB 2 visa application processes. By paying $1440 above regular fees applicable when filing an immigrant petition under preference category II for EB 2 visas, one receives a response within 15 days on his petition filed under category II by paying that extra amount. This option might be useful for people who want their EB 2 visa applications processed quickly. However, premium processing does not apply in national interest waiver cases.
  • Porting Your Priority Date: Priority dates towards the EB1 visa category could act as a means of speeding up the process for individuals from countries with long delays in visa application. It might be easier to get permanent residency through this route, known as the EB1 Visa program, if one applies via it than when using an E-2 Visa. Nevertheless, EB1 Visa qualification requires certain requirements that clients should discuss with their immigration attorneys.

Benefits of Knowing the EB2 Visa Processing Time

Several benefits come with knowing and understanding how long it takes to get an EB-2 visa for both applicants and employers who wish to move overseas:

  • Effective Planning: When immigrants know how long it takes their applications to be processed, they can plan accordingly and set reasonable timelines.
  • Resource Allocation: This helps with budgeting, fee payment planning as well as other expenses associated with the process of applying for visas.
  • Employment Recruitment: Employers can better plan their hiring needs, especially when considering international talent, and take steps to streamline the recruitment and onboarding process.
  • Timing of Life Events: An applicant may accurately time life events such as movement, registration in school, or even family reunification.
  • Strategies to Expedite Processing: Knowledge about processing times gives applicants insight into how they might speed up the process by using methods like premium processing and national interest waivers where allowed by law.
  • Risk Mitigation: Applicants may be able to anticipate potential problems and mitigate risk if they understand what sort of things could cause delays in the system.
  • Ensuring Legal Compliance: It helps keep immigration laws so that there are not any violations or legal challenges involved.
  • Informed Decision-making: Applicants and employers can use this information to decide whether they should look at other types of visas or alter their plans based on how long they expect everything will take.
  • Stress Reduction: Understanding how long each step in your application will likely last decreases anxiety and makes one more organized during the immigration procedure.

Key Terms for EB2 Visa Processing Time

  • Priority Date: This is a very important milestone in the EB-2 visa application process, which dictates when applicants can proceed with their visa application or adjustment of status petition.
  • National Interest Waiver (NIW): This section under category EB2 allows applicants who fulfill its requirements to skip labor certification as required by PERM.
  • Premium Processing: This service speeds up the response time for an EB-2 immigrant petition within 15 days upon payment of an additional fee.
  • PERM Labour Certification: A step where the employer works together with the Department of Labor during the EB2 Visa Processing Time to certify that no worker is available for the position.
  • EB1 Visa: This is a first-preference employment-based green card category that may enable applicants to port their priority date from EB2.

Final Thoughts on EB2 Visa Processing Time

Information about how long an EB2 visa takes to process is crucial for people and companies working on employment-based immigration to the United States. Knowledge of different processing steps like PERM labor certification, priority dates, or premium processing options in terms of details provides the necessary basis for decision-making that is well-guided and minimizes ambiguity around one’s schedule. In addition to this, it creates room for the utilization of strategies such as national interest waivers or porting of priority dates whenever they can speed up things. This makes getting an EB2 visa easy, thus streamlining immigration as a whole which saves time and money while maximizing success.
