Quick Facts — EB2 Visa Lawyers

EB2 visa application allows foreigners with advanced degrees or extraordinary ability in the same field to obtain an employment-based visa for working in America. The EB2 visa is subdivided into two clauses, namely EB2(a) for professionals having an advanced degree and EB2(b) for individuals with a remarkable talent in the arts, sciences, or business. Also, the National Interest Waiver (NIW) within the EB2 is a different class that enables people with exceptional talents to prove that their work is in the United States' national interest without a need for employer sponsorship or labor certification obtained through the PERM process.

How to Apply for the EB2 Visa

  1. Confirm Your Eligibility. Check whether your qualifications, experience, and job offer meet the requirements of the EB2 visa category.
  2. Fill I-140 Form. The employer has to file form I-140, which is known as a petition for alien workers with USCIS.
  3. Get Approved Labor Certification. Regular EB2 visas require a labor certification by the U.S. Department of Labor from employers.
  4. Collect All Required Documents. These include educational and work experience certificates, if any, evidence of exceptional abilities in some cases, job offer letters, financial statements, medical examination results, etc.
  5. Make your Application and Pay Fees. Submit the required documents and fees for the EB2 visa application to USCIS.
  6. Provide Biometrics Data. The applicant must provide fingerprints, a photograph, and a signature during a biometrics appointment.
  7. Go for an Interview. The information provided will be verified through interviews scheduled by US Citizenship and Immigration Services (USCIS) to determine eligibility status.
  8. Wait for the Decision. Afterward, wait until there is a communication from USCIS concerning your application outcome. The processing time varies depending on how much workload is at hand or other factors that might influence it.
  9. Enter USA. If approved then applicants are eligible to enter into United States territory where they can commence working with American employers.

Notice that there might be variations in the requirements and timeframes for the EB2 visa application process, depending on the case and USCIS. One should, therefore, seek advice from an experienced immigration attorney to get guidance on how to approach this procedure specifically for an EB2 visa application.

Eligibility for the EB2 Visa

  • Higher Education: The applicant must possess a higher education degree (master's, PhD, or equivalent) in the field.
  • Extraordinary Ability: The applicant must show extraordinary ability in sciences, arts, or business. This can be seen through achievements like publications, patents, awards, and recognition by peers.
  • Job Offer: There should be an offer of work from a USA employer to the claimant that is related to their expertise.
  • Labor Certification: Applicants who apply for regular EB2 visas are required to have a labor certification from the United States Department of Labor stating that there are no qualified US workers available to fill the position.

It is important to note that for the EB2 National Interest Waiver (NIW), job offer and labor certification requirements can be waived if the work done by the applicant is deemed to be in the national interest of the United States of America.

Required Documents for the EB2 Visa Application

  • Identity Card: A passport needs at least six months of validity beyond the intended stay in the USA.
  • Form I-140: This form should be filed by employers with USCIS on behalf of an employee seeking permanent residence under INA 203(b)(2).
  • Labor Certification: Employers applying for regular EB2 visas must get labor certification from the US Department of Labor.
  • Educational and Professional Papers: These include academic certificates, degrees, transcripts as well as recommendation letters from previous employers highlighting that they meet all eligibility criteria for visa application(s).
  • Proof of Extraordinary Ability: For subcategory b), evidence showing exceptional ability should be provided, such as publications, patents, and awards.
  • Offer Letter: A US employer’s job offer letter specifying duties and salary, among other things, has to accompany the application form.
  • Financial Statements: Bank statements may also serve as proof of financial assistance when you are unable to prove self-sufficiency.
  • Medical Check-up: A medical examination conducted by a physician approved by USCIS must also be submitted along with these records.

However, the exact list of necessary documents may vary depending on your specific case and USCIS requirements. For this reason, it is important to consult an experienced immigration attorney to explain what you should do in order to apply for an EB2 visa in a proper way.

Tips to Succeed with Your EB2 Visa Application

  • Consult Professionals. Engage a seasoned immigration lawyer who can help you navigate through the complex process of applying for an EB2 visa, as this can boost your chances of success.
  • Meet Eligibility Requirements. Make sure that you satisfy all the eligibility conditions for the EB2 visa, including education, experience, and qualifications requirements.
  • Present Documents Thoroughly. To prove eligibility, submit complete and accurate documents. These include educational and employment credentials, proof of exceptional ability if any, job offer letter, financial information as well as medical checks/results.
  • Point out National Importance. In case you apply for an EB-2 national interest waiver (NIW), it is very important to demonstrate that your work is, in fact, in the U.S. national interest so that it may be considered during decision-making on the waiver.
  • Prepare for Your Interview. If there is an interview requirement, one should review their application and be ready to give concise and comprehensible answers about their educational background, job experience, and job offers.
  • Adhere to Instructions. Observe all instructions given by USCIS such as deadlines when submitting required documents or fees.
  • Be Patient. The wait can stretch long before one gets their request granted, hence the need for one’s patience while expecting delays or even follow-up questions.

Key Terms for EB2 Visa Application

  • EB2 Visa: A visa possibility for an alien with outstanding ability and a job offer in the US.
  • National Interest Waiver (NIW): A waiver alternative for EB-2 visas in which the candidate is able to demonstrate that the labor certification process is bypassed by proving that their work is in the national interest of the United States.
  • Labor Certification: A process in which the employer is required to positively prove to the US Department of Labor that there are no qualified US workers available for the job offered to the foreign national.
  • Form I-140: The USCIS form that needs to be filed with the EB2 visa application.
  • Biometric Appointment: An appointment during which an applicant provides fingerprints, photographs, and signatures for the purposes of identity verification and security background checks carried out by USCIS.
