  • Admissibility: The individual must be admissible into US territory, which requires going through background checks and meeting certain health and character requirements.
  • Meeting Eligibility Criteria: The person has to meet eligibility criteria in order to qualify for specific classes of green cards, such as employment-based or family-based.

Various Methods to Get a Green Card

TN visa to green card transition is difficult and time-consuming though it is still feasible. For TN visa holders, there are various ways to get a green card, such as employment-based sponsorship, family-based sponsorship, and diversity visa lottery, amongst others. The following are different methods to get a green card:

  • Employment-Based Sponsorship: A TN visa holder can apply for an employment-based green card if their employer agrees to sponsor them. The employer should submit an application for labor certification with the Department of Labor in the United States, demonstrating that no qualified US workers are available for this position. As soon as labor certification has been approved, the employer can then file a Green Card petition on behalf of a TN visa holder.
  • Family-Based Sponsorship: If a TN visa holder has a partner or relative who is either a citizen of the United States or holds permanent residency status, they may be able to sponsor them for getting the green card. In this case, the sponsor must submit an application for the TN visa holder while showing that they would be able to support them financially. Afterward, once their petition is accepted, they will be allowed to register for their green cards.
  • Diversity Visa Lottery: The diversity visa lottery, also known as the green card lottery, is another popular way through which up to 50,000 individuals from countries with low immigration rates can obtain their green cards in the USA. Eligible nations’ TN visa holders can take part in this lottery, but winning isn’t easy anyway. If chosen, one can apply for a green card provided that they were under a TN visa before being selected.

Duration of Transition from TN Visa to Green Card

The nonimmigrant visa is valid for three years only and can be renewed indefinitely if the holder meets the eligibility requirements. However, an applicant must have a job offer from an American employer in a qualifying profession and possess the necessary skills and education to perform the work.

The time for processing going from a TN visa to a Green Card differs depending on the type of application or country where the applicants come from.
