I have started a claim thru my landlord insurance, the damages are as follows: New oil tank, oil cleanup and restoration, remove all carpets of the unit, and some more

As per the adjuster my insurance would cover all of these but we need to get the tenants insurance to avoid my premium to drastically go up and recoup the 5K deductible, he asked me to search for the tenants insurance.

I'm so sorry about this situation! I want to address your situation with a detailed response, so if you have any questions, don’t hesitate to ask because this law stuff can get complicated. So legally speaking, the law doesn't allow you access to the policy in this case. Not automatically. However, you could always demand this information. You could send a letter stating to her that this is negligence AND IF SHE DOESN'T PROVIDE THAT INFORMATION TO YOU THEN YOU WILL HAVE TO SUE HER PERSONALLY. Negligence simply means that there was a duty that the other party owed and they breached that duty in some way.  What is most important is that it is proven that the defendant breached their duty of care because that is what mostly determines whether there is a cause of action.  Basically, the question is, “Did the defendant’s actions fall below the standard of care for a reasonable person in a similar situation? And did the negligence cause damages?”  If the answer to that question is yes, then there is negligence and you are entitled to financial damages (e.g. compensation for the loss or destruction of property/bodily injury).

You got it. I'm so sorry this happened! Nearly anything can be used as evidence. This is including, but not limited to, written testimony, oral testimony, text messages, photographs, videos, public records, police reports, medical records, etc. So save all your correspondence and try to keep it in writing.
