I have been an attorney for 30 years. I am a Colorado native with many years in Alaska. I have a Bachelors in Biology, Chemistry and French, JD from Seattle University and Masters in Environmental Science and Law from Vermont Law School. I have traveled extensively, mostly in Europe, and speak several languages with more or less proficiency. I practiced law in Alaska and Colorado, much of it in remote areas but also large cities. I have taught in an environmental masters program and run large environmental nonprofits and a hot springs resort. I have worked with and run business incubators, a process I love. Does my Privacy Policy need to address the GDPR?
Same as the CCPA. Should I worry about GDPR given we're a US business?
Ema T.
If you are planning to operate in Europe you will need to address the GDPR. The GDPR is a EU regulation that addresses data protection and privacy of EU residents. It provides specific rights for users located in the EU. These rights should be addressed in your privacy policy and contain additional sections and information laid out for EU residents. Software agreement legal requirements?
I am a software developer who recently entered into an agreement with a client. I am unsure if my agreement meets the legal requirements for software agreements. I want to make sure that the agreement is legally sound and that I am protected from any potential disputes or legal issues that may arise from the agreement.
Thomas L.
I would be happy to review the agreement and offer you advice.

Does my Privacy Policy need to address the CCPA?
I have a website and we have customers from across the US.
Ema T.
If you are planning to operate in California, USA it is recomended to address the CCPA. California is the first state in the US to enact a state statute addressing the privacy rights of the state residents (but it is estimated that other states will follow). The CCPA provides specific rights for users located in CA, those include the right to know what personal data is being collected, whether this data is disclosed or sold to any 3rd party, (and to disagree to the sale), the right to access their personal data, request a deletion of their information, and more. These rights should be addressed in your privacy policy and contain additional sections and information laid out for CA residents. Is agreeing to a ToS the same as signing a contract?
I would like to learn if opt ins to website agreements are the same as signing a contract.
Ema T.
Terms of service can be a binding contract (if your terms of service are not binding they are basically useless). In most cases, if a user had actual or constructive notice that the use of the service is subject to the terms of service and the user has accepted the terms of service online then those terms of service will become a contract just as if the user has physically signed it. If however, after signing electronically the user is also required to sign a physical copy to become a customer the physical copy will usually prevail. Any information provided as an answer to these questions does not constitute legal advice and does not create an attorney-client relationship between the attorney and anyone in relation to any information provided under the Q & A section of this website.

What is a breach of contract? I have signed an EMR software license.
I am a nurse practitioner and I have signed a contact with a company to use their software (EMR) for my Upcoming clinic. Even though the clinic still awaiting credentialing, i have been paying monthly fees. During recent implementation process, i had a conflict with the salesman and he informed me that i have signed a 5 year contract and i am subject to deal with collection agency. I have stoped the process and not trusting to work with this company. The company states that i have a obligation to pay for 5 years if i cancel the contact or to continue to work with them. What should i do?
Forest H.
Your options in a long term services contract will depend heavily on the contract you signed. Rarely are there no options to end a contract early but it would require reviewing the contract and potentially negotiating with the company.
Quick, user friendly and one of the better ways I've come across to get ahold of lawyers willing to take new clients.
