Do you handle Forbearance in Ga?

We currently were in the Forbearance program. My father passed away he is the only one listed on the title, however him and my mother are still listed on the loan. The bank will not let us do a loan motification since my father is deceased . They are wanting the missed payments all at once or they say we loose the house

Hello. First, I would like to say I am sorry for your loss. Regarding your question, I can provide a more general type of answer since more specifics are needed to determine the rights of you and your mother. The ability to continue with a forbearance program under these circumstances depends on the type of program applied to this loan. For example; the COVID hardship forbearance program applies to ALL federally backed and federally sponsored mortgages (HUD/ FHA, VA, USDA, Fannie Mae/ Freddie Mac). Depending on the loan type, a total of 18 months of forbearance may be applied to the loan. If the bank applied a different type of forbearance program, there may be different stipulations and mandates. Therefore, it is important to know what type of forbearance program is being applied and what the stipulations are. In any event, forbearance is an agreement by the bank to not do something (such as place the loan in default for missing a mortgage payment) for some stipulated period of time. The mere fact that your father is the only person listed on title and has passed away, may not change that agreement especially if the loan is federally backed. This is because although many loans and forbearance agreements contain a due on sale transfer provisions, federal law prohibits enforcement of these provisions for federally backed mortgages when the transfer is death related. Thus, depending on the circumstances, the bank may be prohibited from immediately accelerating (requiring "the missed payments all at once").

Can the seller of a commercial property back out of a purchase contract after signing it?

I am in the process of purchasing a commercial property and have signed a purchase contract with the seller. However, the seller has recently expressed doubts about selling the property and has hinted at the possibility of backing out of the contract. I have already invested time and resources into the due diligence process and securing financing, and I am concerned about the potential consequences if the seller decides not to proceed with the sale. I would like to know if the seller has the legal right to back out of the contract after signing it, and if so, what recourse do I have in such a situation?

Generally, the seller cannot legally back out of a properly executed purchase agreement where both parties have signed and acceptance has been communicated. Texas courts have consistently held that unilateral rescission by the seller is not permissible without proper cause and procedure, and attempting to do so would constitute a breach of contract subject to legal remedies. The contract itself may include the penalties for the seller failing to follow through on the sale. You, as the buyer, have multiple avenues for relief, including specific performance, termination and recovery of earnest money, and monetary damages, depending on the circumstances of the breach and the terms of the contract.

I understand that a quitclaim deed is the legal document that I need to do this, but I am unsure of the fees associated with filing the quitclaim deed. I would like to know the cost of filing the quitclaim deed so that I can make the necessary arrangements.

Hi, My name is Shawn Mallett. I am a real estate marketer and seller that is not real estate salesperson licensed. Can you confirm whether or not it is legal for me to utilize an option to purchase contract with a seller/wholesaler with the intention to sell and assign the contract (with the seller knowing this intention) rather than the intention to close on it myself? How much would you charge to confirm the legality of the following contract in both PA and NY and make the appropriate changes if needed? Option to Purchase Real Estate Agreement Date: 06/21/2021 This option agreement is entered between the Parties, Optionor(s) and Optionee(s), below in consideration of and subject to the following terms and conditions. 1. Parties ________________ and/or assigns as Optionee and _________________ as Optionor. 2. Property located in the Town of _________, County of _________, state of _________, to wit: Lot: ___________ Grid Number: ____________ 3. Offer: Optionee has the option to purchase this property at a price of __________________. 4. Period: 3 Years (1,095 days) 5.
