Can my criminal record affect my eligibility for an occupational license?

I am currently in the process of applying for an occupational license in order to work in a regulated profession, but I have a previous criminal record that includes a non-violent offense from several years ago. I am concerned that this record may negatively impact my eligibility for the license, and I would like to know if my criminal history can affect my chances of obtaining an occupational license.

While having a criminal conviction may negatively impact your eligibility for a license, it depends on the specifics of your case. Licensing boards typically evaluate the nature of the offense, how much time has passed since the conviction, and whether the offense is substantially related to the duties of the profession. A non-violent offense from several years ago may not be a barrier to licensure, especially if there is evidence of rehabilitation, there is no subsequent criminal history, and the crime is not substantially related to the purpose of the license. Many jurisdictions have adopted laws or policies aimed at reducing the impact of old or unrelated convictions on occupational licensing decisions. Boards often conduct individualized assessments and may consider factors such as your conduct since the offense, completion of sentencing terms, letters of recommendation, and your overall fitness to practice in the profession. A North Carolina-licensed attorney may be best suited to answer the specifics with regards to your license in North Carolina. If you are concerned about how your record might affect your application, it may be wise to review your criminal history, gather supporting documentation showing rehabilitation, and consult an attorney familiar with occupational licensing in your state. In some cases, I recommend pursuing an expungement or record sealing may also improve your chances in the future.

Can a demand letter be used to recover unpaid wages from an employer?

I worked for a small business for several months and during that time, my employer consistently paid me less than the agreed-upon wage. Despite multiple conversations and promises to rectify the situation, they have failed to pay me the remaining amount owed. I am considering sending a demand letter to formally request payment of the outstanding wages, but I am unsure if this is an appropriate course of action or if there are any legal limitations to using a demand letter in this context.

You can always write a letter and ask politely and professionally, and send the letter certified, return receipt, and keep copies of everything. If you pay an attorney to do this for you, it could cost $1000 or more. Or, for free, you can file a wage complaint for free with the state, here: https://secure.lni.wa.gov/wagecomplaint/#/ You are protected from retaliation from doing so (at least, in theory - there are ways that employer can subtly retaliate).

What are the worst states to hire 1099 independent contractors from because the state will likely classify as an employee?

I'm starting a 1099 remote-based staffing service and I want to stay away from hiring independent contractors with primary residency in states that are unfriendly toward their hiring. I don't want any misclassification issues so I want to stay away from those states altogether.

I'm a Washington State attorney and my answer does not constitute legal advice, and no attorney/client relationship has been formed. If the person working for you will be working remotely from his or her state, the employment law of that state will govern whether the person will be considered an employee or indepedent contractor. Regardless of where that person works, what will be most important is how your contract with that person is written, and how much you try to control the person's work hours, duties, and so forth. Speaking generally, an independent contractor should be given certain work, and a dealine and expectations, and be allowed to work at 2:00 a.m. or 2:00 p.m. and report amount of time worked, such as 8/13/23 1.6 hours. If you have set times for work, such as 8:00 a.m. - 5:00 p.m. Monday through Friday, a court will be more likely to find that the person is an employee, not an independent contractor. If you will be using a person to work in another state, I highly recommend that you consult with an employment attorney in that state to review any paperwork you use, such as an employment contract or work contract with an independent contractor. You can find such attorneys through "lawyer referral" through the state bar association in most states, or you can try finding employment attorneys through this national organization: NELA.org Although the analysis of an employee's/independent contractor will vary from state to state, here are two articles from the US Department of Labor that may provide some general guidance to you. https://www.dol.gov/agencies/whd/flsa/misclassification and https://www.dol.gov/agencies/whd/fact-sheets/13-flsa-employment-relationship I hope that I have been of help.
