I recently inherited a property from my aunt and I am looking to transfer the title to my name. My aunt had created a Quitclaim deed transferring the title to me, but I am unsure of the process to record the deed and make it official. I would like to understand the process of recording a quitclaim deed to ensure that the title to the property is legally transferred to me.

You probably want an attorney to review the deed and make sure it looks ok. You also want an attorney to help you with completing the Preliminary Change of Ownership Form (used by county to determine reassessment of taxes). What happens when a mortgaged house was built on the wrong land?

We have 4 total lots, two in my fathers name and the other two in my grandfather’s name. The builder built my fathers house on my grandfather’s land. I wasn’t aware of this years ago until My father passed away. Who or How do we fix this problem?

Hello. There are multiple solutions to this problem. The simplest solution would be for your grandfather (or whoever the current owner is) to deed the property over to your father's heirs. They could also switch parcels of land. Depending on how long ago the home was built, the owner of the house could potentially have a right to the property via an adverse possession. Yes! Before signing any contract/agreement/lease, or anything that appears to be a binding agreement, it is worth the money to have a lawyer review it. I charge a flat fee to review any and all agreements, so my clients know up front what they are paying, and they consider it a cost of doing business. The alternative, i.e. not having a lawyer review your agreements prior to signing, can be, and usually is, exponentially more expensive should a conflict arise (and they often do).
