Landlord Tenant

Tenant Rental Agreement

Illinois

Asked on Apr 15, 2022

I'm a landlord looking to add a lease clause that allows my tenant to break the lease if he/she covers all rent up until the start of the new tenant's lease. Can you help me?

I'm in Illinois and my current tenant would like to renew the lease but add this clause for flexibility to possibly purchase a house. We discussed that she will cover the rent up until the new tenant moves in.

Mathew K.

Answered Apr 19, 2022

I can draft this addendum to the lease. Please resubmit as a proposal so I can submit a bid at this link: https://www.contractscounsel.com/client/create-project/step-h1?cta=4.

Landlord Tenant

Residential Lease Agreement

Florida

Asked on Sep 11, 2023

Residential lease agreement termination notice?

I am currently in the process of terminating a residential lease agreement that I signed approximately one year ago. I was recently informed by my landlord that I must provide a formal termination notice in order to end the lease agreement. I am unsure of the exact process and what type of termination notice I must provide, so I am seeking legal advice to ensure that I am in compliance with the law and that the lease agreement is properly terminated.

Diane D.

Answered Sep 15, 2023

You will need to read your lease's termination section to find your answers. Without seeing your lease, I assume you need to give a 15 or 30 day notice in writing to your landlord. However, again, without seeing the lease, no one can give you solid infomration.

Landlord Tenant

Rental Agreement

Washington

Asked on Oct 9, 2023

Are there automatic renewals in rental agreements?

I am looking to rent a property and have read the rental agreement, however, I am unsure if there are any automatic renewals in the agreement. I have heard that sometimes rental agreements are set up to automatically renew after a certain period of time, but I am not sure if this is the case with my agreement. I am looking for clarity on whether or not the agreement I am signing includes any automatic renewals.

Merry A.

Answered Oct 14, 2023

Residential month to month rental agreements and/or residential lease agreements often include terms regarding whether or not an agreement automatically renews. However, the Washington State Residential Landlord Tenant Law and/or ordinances in certain WA cities sometimes may provide the answer to your question. https://apps.leg.wa.gov/rcw/default.aspx?cite=59.18

Landlord Tenant

Rental Agreement

North Carolina

Asked on Oct 6, 2023

How to draft a fair rental agreement?

I recently moved to a new city and am looking to rent an apartment. I am unfamiliar with the laws and regulations around rental agreements in this area, and I want to make sure that I create a fair and legally binding agreement with my potential landlord. I want to make sure that both my rights and those of my landlord are protected.

N'kia N.

Answered Oct 15, 2023

North Carolina General Statute 42 contains the North Carolina Residential Rental Act i.e. the landlord-tenant law. Generally, North Carolina landlord-tenant law requires that (1) a residential landlord keeps the property fit and habitable and (2) a residential tenant keeps the property safe and sanitary, pays the rental fee at the time and in the amount agreed upon, and follows (valid) agreed-upon rules. It also addresses other important issues like security deposit, late fee, required notice, termination, and eviction. One important aspect of the statute is that it does not allow a residential landlord to avoid or disclaim certain responsibilities simply by having a tenant agree in a rental agreement. Another important aspect of the statute is that it allows a residential tenant to recover money from a landlord who engages in certain particularly egregious conduct. It is important for a future residential tenant to know each party's rights and responsibilities before entering into a residential rental agreement. If you are considering signing a North Carolina residential lease, you are entitled to have an attorney review it and advise you before you sign.

Landlord Tenant

Residential Lease Agreement

North Carolina

Asked on Sep 11, 2023

Insurance in a residential lease agreement?

I am a tenant who is about to sign a residential lease agreement with a landlord. I am concerned about the insurance requirements of the agreement and what type of insurance coverage the landlord and tenant are responsible for. I want to make sure that I am adequately covered in case of any accidents or damages that may occur during my tenancy.

N'kia N.

Answered Sep 24, 2023

North Carolina does not require a residential landlord to maintain landlord insurance and does not require a residential tenant to maintain tenant ("renter's") insurance. However, when a residential lease agreement requires a tenant to carry renter's insurance, it will specify the minimum amount of coverage required. Generally speaking, landlord insurance covers a landlord and tenant ("renter's") insurance covers a tenant. For example, landlord insurance is likely to cover a tenant's injuries or damages related to the landlord's negligence but is not likely to cover the tenant for more general liability purposes. Ultimately, a tenant is responsible for maintaining the minimum amount of renter's insurance required by the residential lease agreement. Otherwise, the tenant may be liable for violating the lease. However, a tenant may choose to maintain renter's insurance with more coverage than required. Exactly how much coverage a tenant needs will depend on that tenant's specific circumstances.
