Can I work for a competitor with my current noncompete?

I have ended my non competent consulting agreement with my current employee and I have an offer to work as an employer “not as consultant” with a competitor company to my privious employees so can I work as an employee without any problem? The consultant agreement says the following: Under any circumstances the consultant shall not engage directly or indirectly either as a principal agent , consultant,stock holder , partner or in any other capacity whatsoever have any other relationship with any business which compete with the company in USA.

I recently accepted a position at a new company and I was given an employee handbook to review prior to my start date. I noticed that the handbook does not include any information on family leave policies. I am wondering what the company's policies are related to family leave and how they may affect my employment. I would like to understand my rights and responsibilities as an employee when it comes to family leave.

Generally, employers must have at least 50 employees at your location or within a 75-mile radius of your location to be covered under the FMLA. Further, employees of covered employers are not eligible for FMLA leave until they have been employed for at least 1 year and have worked at least 1,250 hours within the past 12 months.

How to end an employment contract?

I am currently an employee with an employment contract, but I am considering terminating my employment due to various reasons such as a breach of contract, a hostile work environment, or a desire to pursue other opportunities. However, I am unsure of the legal requirements and consequences of ending the contract before its specified end date. Therefore, I would like to seek the advice of a lawyer to better understand the steps involved in terminating an employment contract and to ensure that I am protected legally.

Connecticut is an "at will" state which means employers in the private sector can end the employment for no reason at all or without notice. This should be the same for an employee, however, most people give an industry standard of about 2 weeks when leaving. It will depend on the employment agreement that you signed. How to make a contract to keep IC status ? We are getting audited by SF. Thank you!!

I just changed to independent contractor last year after all my dental friends advised me to do so. Now the office I work at is being audited so I’m wondering what I need to do in order to keep the IC? Thank you !

In general, contract terms can make someone an employee, but cannot ensure independent contractor status. Essentially, the contract can set out IC terms, but if those terms are not followed in practice, the contract itself can't fix that. Under California AB, there is an exemption for dentists from the strict "ABC" test, but dentists will still need to meet a number of other requirements that are often, in practice, difficult to meet. For example, they would have to be "open to the public" and actually performing the same of similar services for others - so working for a single dental office typically will not pass the test!

My wife & I thought we had a contract from her employer to buy A dental practice after working for them for three years. We now were forced to sign a contract with the people that bought him out to continue working for them so they can get 10x EBITA when they sell shortly. Do we have a case for lost wages?

We moved from 30 miles away because we were told if we worked for 3 years we could buy it for $525,000. They now want $2.5M.

The first question is do you have a fully executed written contract? This is the first step to determine the terms and conditions such as your wages if there is a breach of contract, the dentist being able to assign the contract and if it can be modified.
