I close residential and commercial real estate transactions. Myself and my paralegal work hard to ensure that every closing is properly executed. I can write title insurance policies with two companies First American and AmTrust. We are a small title company, but we are capable and efficient. I love what I do and I would love to provide closing services for you as well. I am also a licensed real estate agent. I do not actively practice real estate in the sales agent capacity because of my real estate closing practice. I remain current with policies, procedures, issues and trends. I am available to help anyone buy or sell a home or refer them to someone who will do an excellent job.

Physician Employment Agreement

Florida

Asked on Jul 7, 2023

Are physician employment agreements required?

I am a physician who is considering a new job opportunity. I have been presented with an employment agreement, but I am unsure if I am legally obligated to sign it. I am looking for guidance on the legality of physician employment agreements and whether or not I am required to sign one.

Daniel D.

Answered Jul 18, 2023

Physician employment agreements are not required by Law but that does not mean they are not required by the Employer. Employers have these agreements in place to set the terms of the employment regarding salary, length of employment and any other relevant terms that they want the employee to agree to. But, that also means you as the employee could negotiate provisions into the agreement that you want if the employer is willing to put them in. You legally don't have to sign one, but your future employer can still require a signed agreement. Before you sign anything you should make sure you understand the terms and provisions of the agreement.

Employee Separation Agreement

Texas

Asked on Jun 13, 2023

When to use an employee separation agreement?

I am an employer considering letting an employee go and am looking to understand when an employee separation agreement is necessary. I am unsure of the distinction between an employee separation agreement and other termination documents and want to ensure that I am following the proper protocol and protecting my business in the event of legal action.

Wendy C.

Answered Jul 18, 2023

Separation agreement is usually helpful when separating with an employee amicably and includes other terms that you want to ask of the other party and which you will also make promises. In other words, it is a two-way (or mutual) agreement. A termination letter is most likely a one-way communication, a notice that such employee is being terminated. You should talk to your preferred counsel to discuss facts in detail and make a determination which one will be the right approach.

Employee Non-Disclosure Agreement

Florida

Asked on Aug 8, 2025

Version: Can an Employee Non-Disclosure Agreement prevent me from discussing workplace harassment with others?

Version: Can an Employee Non-Disclosure Agreement prevent me from discussing workplace harassment with friends, family, or other colleagues, as I have recently experienced harassment at my workplace and want to seek support and advice from trusted individuals outside of the company? I am concerned that the agreement I signed when I started my employment may restrict my ability to talk about these issues and potentially hinder my efforts to address and resolve the harassment situation.

Dimitry K.

Answered Aug 12, 2025

The answer here is strongly dependent on the language itself within the non-disclosure agreement. For example if there is language pertaining to disparagement, such terms often do limit the ability to communicate information with third parties, with some limitations such as law enforcement, federal agencies, or legal representation. Without reviewing your specific agreement it is hard to give a clear answer but it is a distinct possibility that the language can indeed restrict communication with third parties, especially if you received some manner of financial benefit from signing the agreement with the employer.

Dental Associate Contract

Washington

Asked on Aug 1, 2023

How to track dental associate contracts?

I am a dentist who is looking to hire a dental associate to help with my practice. I need to create a contract that outlines the terms and conditions of the associate's employment, but I want to make sure that I am tracking it properly. I want to make sure that I am following all the legal obligations related to the contract and that it is enforced properly.

Merry K.

Answered Aug 25, 2023

It's not necessary to write a contract - you can write a hiring letter with the terms and conditions, with a reminder that the employee is an "at will" employee. This may give you more freedom to discipline or terminate the employee than an employment contract would. However, you can also write this up as a contract. In either instance, do not violate any laws, such as the state and federal laws against discrimination (some counties and cities, such as King and Spokane counties, and Tacoma, Seattle, and possibly Spokane may have additional provisions); watch out for RCW 49.44.211, a 2022 law about nondisclosure and nondisparagement provisions; and, if you choose to include regular evaluations in your letter or contract, the most simple thing is to track those on a calender and remind yourself and your employee of the date a few weeks ahead of time. Some hiring letters and employment contracts provide for reimbursing the employer for the costs of training and/or any costs provided to the employee for moving expenses if the employee leaves before "X" amount of time.. Before hiring any new employee, do your best to conduct a national background check (not just state) and make sure it's extensive - prior performance at another job? Was the work history and education what they say it was? Any misdemeanors or felonies? What is their financial history and credit rating? Etc. Good luck on your hiring decisions.

Physician Employment Agreement

Florida

Asked on May 25, 2023

Physician employment agreement termination clauses?

I am a physician who has been recently offered an employment agreement from a hospital. I am interested in understanding the termination clauses of the agreement, as I want to make sure that I am not at risk of being terminated without cause or without due process. I am also interested in understanding what my rights are in the case of a termination.

Diane D.

Answered Jun 9, 2023

I would need to see your Employment Agreement to be able to answer this. I suggest you enter a work order in ContractsCounsel, and you can request me or have multiple attorneys bid on it.
