Can I file an EEOC complaint for workplace discrimination based on my disability?

I have been working at my current job for several years and recently I have been facing discrimination from my supervisor due to my disability. Despite providing all necessary documentation and accommodations, my supervisor has been consistently undermining my work, excluding me from important meetings, and making derogatory comments about my disability. I am now considering filing an EEOC complaint, but I am uncertain about the process and if I have a strong case.

Short answer: Yes. There are some siginficant deadlines (180 days and up to 300 days) you will need to meet, forms to fill out, and a venue to choose (California law vs. Federal law). Without more specific it is difficult to give you specifics, Thus, given the deadlines and the specifics of your case, I HIGHLY recommend you speak with an employment lawyer very quickly to fully understand where you in the timline, what you will need to prove, and where to file -- and more importantly, if you have a case. I recently accepted a new job and was given an employee handbook to read over. I read the policies regarding vacation time, but I am unclear about how exactly the policy works and what the process is for taking a vacation. I want to make sure I understand the policy correctly and that I am following the correct procedure for requesting vacation time.

Hello - I am a Washington State employment law attorney. It can often be difficult to understand a policy in an employee handbook. I would suggest two things: (1) Do not ask about the policy or how to interpret it until you have completed at least two months on the job - wait until your supervisor and coworkers get to know you; most likely, you are not eligible for vacation leave until you have been on the job for several months anyway. (2) After two months, ask your supervisor about the policy - not HR. Your supervisor is most likely the person who will have to approve your leave, and he or she will appreciate that you went to him or her instead of going to HR.

I am a physician who is considering a new job opportunity. I have been presented with an employment agreement, but I am unsure if I am legally obligated to sign it. I am looking for guidance on the legality of physician employment agreements and whether or not I am required to sign one.

Physician employment agreements are not required by Law but that does not mean they are not required by the Employer. Employers have these agreements in place to set the terms of the employment regarding salary, length of employment and any other relevant terms that they want the employee to agree to. But, that also means you as the employee could negotiate provisions into the agreement that you want if the employer is willing to put them in. You legally don't have to sign one, but your future employer can still require a signed agreement. Before you sign anything you should make sure you understand the terms and provisions of the agreement.

Generally, employers must have at least 50 employees at your location or within a 75-mile radius of your location to be covered under the FMLA. Further, employees of covered employers are not eligible for FMLA leave until they have been employed for at least 1 year and have worked at least 1,250 hours within the past 12 months.
