Can a landlord change the terms of a rental lease agreement without the tenant's consent?
I recently signed a rental lease agreement for an apartment, which clearly outlined the terms and conditions of the tenancy. However, my landlord has informed me that they intend to make changes to the lease agreement, specifically regarding an increase in rent and modifications to the maintenance responsibilities. I am concerned about the legality of these changes and whether a landlord can unilaterally alter the terms of a rental lease agreement without obtaining the tenant's consent.

I am currently renting an apartment and have a signed rental agreement with my landlord for a fixed term of one year, with a specified monthly rent. However, recently my landlord informed me that they intend to increase the rent starting next month. I was under the impression that the rent amount was fixed for the duration of the agreement, so I am seeking clarification on whether a landlord has the right to increase the rent during the term of a rental agreement.

Hello! My name is Damien Bosco, Esq. My law office is in Long Island City, across from Manhattan. Generally, you are correct. For an annual lease with a fixed monthly rate, a landlord cannot increase the monthly rent during the pendency of the lease. Sometimes, the lease may allow for such an increase, but only if there is a provision in the lease that allows for it. If your lease does not include a rent adjustment clause and you believe the landlord is acting improperly, you are within your rights to challenge the increase. Can an addendum to a lease be used to modify the terms of a lease agreement?
I am currently renting a commercial space for my business, and I recently received an addendum to the lease agreement from my landlord. The addendum contains several changes to the original lease terms, including an increase in rent and modifications to the maintenance responsibilities. I am unsure if the landlord has the legal right to make these changes through an addendum, and I would like to understand the validity and enforceability of this document.

Hello! I'm so sorry about this situation! To modify a contract legally, the following requirements must be met: 1. All parties to the contract must agree to the modification. This means that both parties must sign and date the amendment to the contract. 2. The parties to the contract need new consideration -- something of legal value -- to modify a contract. For example, if a party wants more money for something they would need to provide additional performance in exchange. 3. A writing is not required for a modification, but recommended. In your case, you said that you received the addendum to the lease agreement and it contains changes to the original terms, including an increase in rent. An increase in rent would be a change to a material term, requiring you to pay more. Because you would be required to pay more, your landlord would have to offer something in exchange for this to be binding. This means that unless the lease was up for renewal, the modification would be invalid. Thanks again and good luck!

Can I terminate my lease early without penalty due to unforeseen circumstances?
I signed a one-year lease for an apartment last month, but my circumstances have drastically changed and I am no longer able to afford the rent or live in the area due to a sudden job loss and financial hardship caused by the COVID-19 pandemic. I have tried to negotiate with the landlord to terminate the lease early, but they insist that I am responsible for the full lease term and any associated penalties for breaking the lease. I want to know if there are any legal grounds for me to terminate the lease without incurring additional costs or penalties given the unforeseen circumstances that have arisen.

You should review the termination provisions in your lease, but generally the answer is no - you cannot terminate early unless your Landlord agrees to the termination in writing.

Are rental agreement templates reliable?
I recently signed a rental agreement that I found online. I was told that it was a legally binding document, but I am concerned that it may not be reliable because it was not drafted by a lawyer. I would like to know if rental agreement templates are reliable or if I should have the agreement reviewed by a lawyer.

A Washington State residential landlord/tenant template may or may not be reliable depending on who drafted it or provided it, whether or not it applies to a particular situation, and whether it is up to date (in 2023, WA State made several changes to the law). You can review the state law here: https://apps.leg.wa.gov/rcw/default.aspx?cite=59.18 However, some cities/counties have additional requirements and/or provisions that also must be followed. It would have been a good idea to have an attorney review the document BEFORE you signed it.
