Trying to sell home. My title company having issue settling the debt. Title company contact loan to payoff, but no record of my property was found. Only past owner current home is on the loan. Quit Deed was done 2012. In 2015 past owner loan was passed to a different company who record in Florida my parcel number. So basically I can't pay loan off because my home is not attached to her loan. I still can't clear title because lien was recorded 2015 in Fl court house, but The past owner was no longer on deed. Looking to hire a lawyer to clear title, so I can sell my home.

This sounds complicated enough that you need a lawyer to get involved. Do you have a title insurance "owner's policy"? If so, that might get you a free lawyer (I can't tell from the facts you presented whether that will work). Also, you've tagged this question as a Virginia question, but you mention the lien being recorded in Florida. You need an experienced lawyer in the jurisdiction in which the property is located. If the house is in Virginia, you need a Virginia lawyer; if in Florida, you need a Florida lawyer. If it's a lien on Virginia property from a Florida judgment, then you need a Virginia lawyer, because that's where the property is located.

Generally speaking, getting your friend "off the title" just needs a deed granting you his interest in the property. A real estate lawyer could prepare such a deed for only a few hundred dollars. But that does not include having a title examination done, and it doesn't include the recordation cost (the deed needs to be recorded in the local land records, and the cost varies).

Hello! I hope you are well! If X is contesting a defective or invalid deed, and the quitclaim deed has been recorded for at least five years, then the deed will be considered valid. Under Oklahoma law, an instrument (in your case, the quitclaim deed) that has not been acknowledged or which contains a defective acknowledgment shall be considered valid notwithstanding such omission or defect, and shall not be deemed to impair marketability, provided such instrument has been recorded for a period of not less than five (5) years. 16 O.S. §§ 27a & 39a. I would note that my response is limited based on the information that you have provided and that each individual situation may present its own unique issues. I hope this helps!

Closing date in a purchase and sale agreement?
I am in the process of purchasing a property and have a Purchase and Sale Agreement in place. The agreement includes a closing date, but I am uncertain as to what the implications are if this date is not met. I am interested in understanding my rights and obligations concerning the closing date, and any risks that I could be exposed to if the date is not adhered to.

If a closing date on a purchase agreement is not met, generally the party who has breached the agreement may not be allowed to close the transaction. Often there are penalties contained in a purchase agreement to reimburse the non-breaching party for their time, expense and fees caused by the breach of a party to fail to close on a closing date. However, if the parties are both working toward closing the sale, but certain impediments get in the way of a timely closing (such as a survey which is not completed, or a lender not having approved a loan in a timely fashion), the buyer and seller will often reach an agreement to continue the closing date to a later date. In some cases, a seller might require a buyer to pay a further amount on the deposit to insure that the buyer intends to proceed, particularly if the buyer is to forfeiet the deposit as a result of its failure to close the transaction.
