I am an employee of a company and I recently received a copy of the Employment Handbook that outlines the rights and responsibilities of the employees. After reading through the handbook, I am concerned that some of the policies may not be in compliance with the law. I want to make sure that my rights as an employee are being respected and that I am fully aware of any legal obligations that I may have.

Hello - I have been an attorney for nearly 38 years and specialize in employment law. It would be helpful to know what policies concern you, but be aware that federal and state law, and usually county and city as well, override any policies that are incorrect. Meanwhile, keep in mind that if you are an "at will" employee you have few, if any rights (other than certain ones protected by law); that sometimes employers don't keep up with updating their polices; and that HR is not your friend. If you feel your rights are not being respected, you may want to book a 30 or 60 minute consultation with a WA State Employment attorney. If you feel you have been or are being discriminated against because of a protected class status, you can also file discrimination complaints with the WA State Human Rights Commission and/or the EEOC. If you are not getting the wages you should be receiving, you can file a wage complaint with the state; you will be protected from retaliation for doing so. If you feel your working conditions are unsafe, you can file a complaint with the WA State equivalent of OSHA, and/or with OSHA (federal). Best wishes, Merry

I recently left my job after signing a Noncompete Agreement. I am looking for a new job, but I am concerned about the restrictions in the Noncompete Agreement and how it might affect my ability to find a new job. I am looking for advice on my options for terminating or modifying the Noncompete Agreement so that I can find a new job without having to worry about any potential legal repercussions.

I am a WA State employment attorney. If you didn’t receive anything in return for signing the non-compete, it may be relatively easy to get out of it. If, however, you signed in return for something, such as a severance package, it will be challenging to get out of the agreement. However, many non-compete agreements are written overly broadly and may not be enforceable under the laws of WA and other states. You may want to consult with a WA State employment attorney for a review of the documents and law(s) of the state(s) where you may want to work or set up a business. (A WA State attorney can only provide legal advice in WA, but can help you find applicable law/case decisions for other states but without providing anything beyond information, much like a law librarian).

I am concerned about the malpractice insurance that is included in the contract, as I am not sure if the coverage is adequate. I am a WA State attorney. For starters, obtain a copy of your policy, print it, and read it carefully, using a yellow highlighter to highlight your questions/concerns, while making notes on a notepad. Check with independent malpractice insurers in WA to determine typical amounts of coverage in your field and county. Consider buying more on your own and/or an umbrella policy. Check with instructors, mentors, and colleagues in your field to seek guidance on adequate coverage.

Can a demand letter be used to recover unpaid wages from an employer?
I worked for a small business for several months and during that time, my employer consistently paid me less than the agreed-upon wage. Despite multiple conversations and promises to rectify the situation, they have failed to pay me the remaining amount owed. I am considering sending a demand letter to formally request payment of the outstanding wages, but I am unsure if this is an appropriate course of action or if there are any legal limitations to using a demand letter in this context.

You can always write a letter and ask politely and professionally, and send the letter certified, return receipt, and keep copies of everything. If you pay an attorney to do this for you, it could cost $1000 or more. Or, for free, you can file a wage complaint for free with the state, here: https://secure.lni.wa.gov/wagecomplaint/#/ You are protected from retaliation from doing so (at least, in theory - there are ways that employer can subtly retaliate).

How to compare multiple employment offers?
I recently received multiple job offers and I'm having difficulty deciding between them. I'm trying to weigh the pros and cons of each offer, and would like to know what considerations should be taken into account when comparing multiple employment offers. I'm concerned about the salary, benefits, vacation time, and job responsibilities, but I'm not sure what other factors I should consider.

Congratulations on receiving multiple job offers. In addition to what you listed as considerations, above, you can review things such as whether these are all for employment (rather than independent contractor); whether you would be considered "at will" or would be given a number of rights as an employee; and whether the employer would provide training/mentorship etc. If I were in your shoes, I'd compare reviews of each employer, as an employer - this can be hard to find, but Glassdoor.com has a limited number of reviews of certain employers. If at all possible, reach out to some current employees at each company and ask the same or similar questions, such as "what do you like or dislike most" about your job and the employer?
