Before becoming a lawyer, he clerked at the Lewis & Clark Small Business Legal Clinic where he handled a diverse range of legal issues including establishing new businesses, registering trademarks, and drafting contracts. Diamond R.
July 29, 2023 My name is Diamond Simpson Roberts, ESQ, MSPH and I am convinced that I can be a value added asset to most any company. As the first in my family to graduate a four-year university, I graduated from Wayne State University Law School in 2000 but could not afford a bar prep course upon completion. After over 20 years, I sat for the July 2022 UBE, successfully passed and am currently licensed in three states! This is an example of my self-motivation, internal drive and passion. I offer over 28 years of diverse experience in healthcare, strategy, sales/marketing, legal/policy and business savvy. I have many years building, leveraging, and sustaining long term relations to drive revenue as an entrepreneur and for corporations. My analytical strengths provide me with an innate ability to think through tough situations/topics while viewing both vantage points (which is excellent for law and life). I have been appointed to serve on numerous committees due to my heightened ability to identify client issues and priorities and provide solutions based upon relevant products, services and needs. I have led teams with and without authority; specifically, I have managed teams for an Adult Foster Care Facility called Etonne Cares, during my post-graduate fellowship with the largest Catholic Healthcare System in the U.S. and during my two-year executive order appointment with the Federal Government (Presidential Management Fellowship). Most importantly, I am a collaborative team player who knows how to improvise, overcome and adapt! I offer numerous years of being a pharmaceutical trainer and being an adjunct using the online platform. I welcome the opportunity to continue in the interview so that I may further highlight the skills I can (and will) contribute to my success in the role. Respectfully, Diamond Simpson Roberts, ESQ, MSPH DQSSIMPSON@GMAIL.COM M: 313-942-6747

Demand Letter

Drafting tone in a demand letter?
I recently received a demand letter from a creditor for an unpaid debt. I am unsure of how to respond in a way that is both respectful and firm. I am concerned about the tone of my response and I would like to make sure that it is appropriate and in line with the law.
Merry A.
It is always an excellent idea to (1) Use a polite and professional tone, along the lines of how you would write if your letter could end up in front of a judge some day; (2) Have a friend or family member review your letter with you before you send it; and (3) include all your pertinent contact information. However, I do want to mention that when you write back, if you don't know what the debt is for, you are within your rights to request written verification of what the debt is for - I mention this because there is a popular scam of sending fake debt collection letters to people and causing them all kinds of stress and distress.

Citing laws in a demand letter?
I recently sent a demand letter to a person who I believe owes me money. I am trying to collect the payment they owe me, but they are refusing to pay. I included a few laws in the demand letter that I believe are relevant to my situation, but I am not sure if I have included all of the necessary laws. I would like to make sure I am citing all of the applicable laws in my demand letter so that I can ensure the payment is collected.
Merry A.
Unfortunately, often, one can cite all the laws one wants, but the person who owes the debt may simply be unwilling or unable to pay. If the debt is for less than $10,000, consider filing in Small Claims Court in your county. Here is the statewide information: https://www.courts.wa.gov/newsinfo/resources/?altMenu=smal&fa=newsinfo_jury.scc In addition, many counties, such as King, have their own websites and lots of information. When you file in Small Claims Court, be sure to include copies of all relevent paperwork, including any letters you sent to the defendent. And request reimbursement for the debt, interest, the cost of filing the Small Claims case, and any related costs/expenses. Even if you win, however, you may not get paid - but if you win, you will have some other ways to collect, such as garnishing wages or a bank account. I'd be happy to help coach you through the Small Claims process if you'd like to request my help through ContractsCounsel.com

Creditor rights in debt settlement agreements?
I recently entered into a debt settlement agreement with my creditor, but I am worried that my rights may be violated during the process. I am concerned that the creditor may not abide by the terms of the agreement, or that they may not provide me with the full protections that I am entitled to under the law. I am hoping to get some clarity on my rights as a debtor in this situation so that I can protect myself.
Diane D.
Without seeing the settlement agreement, there is no way to tell if your rights, or what you believe to be your rights, are covered. Also, if they don't abide by the contract, you can take them to court.

Demand letter and statute of limitations?
I recently received a demand letter from a creditor regarding an unpaid debt. The letter states that I must pay the full amount within 30 days or they will take legal action. I am concerned that the debt may be outside the statute of limitations, and I wanted to know what legal recourse I have in this situation.
Myrna L.
If you are certain that the debt is time barred, debtor may not sue you. In California, there is generally a 4-year limit for filing a lawsuit based on a written agreement. Just make sure you don’t inadvertently restart the statute of limitations, i.e. acknowledge the debt.

Note Payable
New York
I need to sue on an unpaid promissory note
The note was written back in March 2019 I hired an attorney and he has done nothing for me! I made tons of requests to try to settle out of court with this man and he just keeps blowing me off
Matthew S.
You need someone who will attempt to settle the matter for you and if that fails be prepared to sue on the note and take the necessary action to collect. This assumes the debtor has assets to collect against. It can take a while. I have had some folks pay relatively promptly, others several years. Communication between attorney and client is very important in this process. If you have no idea what is going on in your case you can get very anxious. I make sure you get consulted on each development and you get copies of each filing.
