If a new company takes over my wedding venue is my original contract still valid at all?
I originally signed a contract months ago for my wedding venue. The venue was free as long as a $5,000 catering minimum was hit. Now a new company took over the venue and they are charging $3000 to use the venue not including catering and regardless of any food and beverage minimum. Needless to say this is about $3000 more than I was anticipating to spend. Is this legal?

I know people hate this answer from attorneys, but it depends on the wording of the contract and the specific facts of the situation. Most contracts will have a clause governing assignment of the contract to a third party. That clause will determine if the terms of the original contract are assignable to the new company operating the venue. If the contract is not assignable, or if the original operator decided not to assign the contract to the new operator, then you will have a new agreement with the new operator. Most contracts will also have a clause governing how the terms of the contract can be changed. If you would like a review of your situation and your contract, you can request a proposal for a review session. I generally do those at a flat fee, based on the length of the contract. I'm sure other attorneys would offer similar rates.

Hi there, Yes, you can modify a consulting agreement by preparing an amendment, and having both you and the independent contractor sign it. The key is having the contractor first agree to any changes in principle, and then making sure the amendment (1) accurately reflects those changes, and (2) includes other standard language ensuring the continued integrity and enforceability of the original agreement.

The ramifications of terminating a membership agreement with a fitness club is going to depend highly upon the contract that the club and the club user have executed. The devil is most definitely in the details in any contract. Have your contract reviewed by an attorney with years of experience in contract review/drafting, etc.

Should I sign a contract if the terms and conditions don't apply to what I am buying?
I am about to sign a contract to rent a venue for my wedding ceremony (not reception). In the terms and conditions they state that I am responsible for paying $10,000 overtime per hour over the contract (which includes venue, staffing ,bar package). However I am having a ceremony only, there is no food or beverage being provided. And the only staff are 2 people to set up the room. Overall it seems the terms and conditions are more for a reception, not just a ceremony. Bottom line, should certain terms and conditions be removed from my contract if they do not apply to my ceremony?

Absolutely. Please do not sign a contract with terms that do not apply to you. Once signed, you would then be bound by those terms and conditions. Go back and ask them to remove the sections that do not apply to you before you sign.
