Legal Documents Guide
What legal documents do you need for an Airbnb Business?
When running an Airbnb business, you need certain legal documents to protect yourself, your business, and your property. The necessary documents will vary based on the location of your Airbnb and what services you offer as a host.
Keep reading for a list of some of the legal documents that you may need:
- Business License : Depending on where your Airbnb is located, your jurisdiction may require certain businesses to obtain a business license or permit to operate an Airbnb. You can check with your local government to see if licenses are required.
- Short-Term Rental Agreement : A short-term rental agreement, sometimes called a vacation lease agreement, is a legal document between you and the guests renting your property. It will include important information like fees, rental period, parking accommodations, and other conditions.
- Liability Waiver : A liability waiver is a legal document that releases you from liability in the event of property damage, personal injury, or other issues that may arise at your Airbnb during the rental period.
- Insurance : Regular homeowners insurance doesn’t usually cover vacation rentals like Airbnbs. You may need to find an insurance policy that specifically covers homes used for short-term rentals. The proper insurance will protect you and your property against accidents or damages that may occur during the rental period.
- Lease Agreement : If you lease the property you rent on Airbnb, you will need to execute a lease agreement with your landlord. The lease agreement must include permission to sublet the property to other renters.
- Non-Disclosure Agreement : A non-disclosure agreement is a contract that upholds the confidentiality of proprietary information. This document is used with third parties who may have access to confidential business information.
- Privacy Policy : If your Airbnb business collects personal data from renters and guests, a privacy policy will inform your guests how you collect, use, and protect their information.
- Payment Authorization Form : When running a rental business, there are often extra fees that an owner needs to charge their guests. A payment authorization form allows you to charge guests for additional costs like security deposits or damages.
- House Rules : House rules outline the expectations and guidelines for guests staying at your Airbnb. This essential document should include check-in and check-out times, permissible noise levels, and other policies.
Running an Airbnb can be complicated, and it is essential that you protect yourself and your property with legal documents. Always consult an experienced real estate lawyer to determine which documents are necessary for your business and jurisdiction. Don’t forget to review Airbnb’s policies and legal requirements, which may differ from your local regulations.

Quick, user friendly and one of the better ways I've come across to get ahold of lawyers willing to take new clients.
View Trustpilot ReviewContracts Counsel was incredibly helpful and easy to use. I submitted a project for a lawyer's help within a day I had received over 6 proposals from qualified lawyers. I submitted a bid that works best for my business and we went forward with the project.
View Trustpilot ReviewI never knew how difficult it was to obtain representation or a lawyer, and ContractsCounsel was EXACTLY the type of service I was hoping for when I was in a pinch. Working with their service was efficient, effective and made me feel in control. Thank you so much and should I ever need attorney services down the road, I'll certainly be a repeat customer.
View Trustpilot ReviewI got 5 bids within 24h of posting my project. I choose the person who provided the most detailed and relevant intro letter, highlighting their experience relevant to my project. I am very satisfied with the outcome and quality of the two agreements that were produced, they actually far exceed my expectations.
