Contract Dispute with Fundraising Service Provider
"In my opinion, this is taking too long to get to a resolution given the amount of detail and documentation that was provided for it. The other party does not respond in a timely manner and has not given Donya any proof of charges yet to make their case. In the meantime, my attorney fees keep adding up while we wait for them to respond accordingly. The one thing I have an issue with is that it took almost a month to reach out the other party for the first time. It was my hope that this would be handled in an expedited manner because I think that's what I asked for in my request for counsel. I can't afford to contiune to wait for the other party to drag their feet on providing proof of charges while my attorney fees continue to add up. I was hoping for a proposal for resolution by now, but I don't see one in site anytime soon."

When there is a contract dispute, especially one where a lawyer was not initially hired to review the contract to ensure the protections needed, it requires the participation of the other party. Without that necessary participation, the reality of a settlement or a negotiated agreement is not real. As you cannot force a party to engage in settlement of the dispute, especially when your contract does not allow for that protection, you will always continue to have cost associated with trying to get to that settlement, even if settlement does not become a reality.

Fiction Publishing Agreement Review
"I received a book contract from a small independent press and needed it reviewed by someone with experience in the book world. Donya provided us with exactly what we needed; she reviewed the contract, added clarifying language (specifically around time tables, arbitration, and accounting) and wrote a carve out for audiobook rights that was discussed between me and my publishers but did not make it into their proposed contract. When I expressed anxiety about the evolving landscape of AI and how it intersected with publishing, she was very responsive and added an additional item regarding AI and limiting AI use in regards to my work. She understood that we were working with a small publisher and focused on small, reasonable, clarifying edits, but I have no doubt that had I needed a more aggressive approach, Donya would have been able to handle that just as easily and professionally as she did this contract. I just need somebody to review a publishing contract for me. I want to ensure that it's legit. and ask a question or two about it.
"Donya was outstanding. She addressed all of my questions and then some. She added specific language to the contract about severability, a waiver clause, and an arbitration clause--all things that will protect me in the event of a contract dispute, and all things the publisher would probably be happy to overlook. She also raised questions about the royalty structure and the other terms of payment (they weren't specific enough). She raised a good question about the agent's compensation. It was not clearly specified in the contract (the percentage was given, but it wasn't clear what the percentage referred to). And she raised a question that hadn't even occurred to me: What happens if the publisher decides not to publish the book? Do I have to pay back my advance on the royalties? That was not specified in the contract. Donya was very friendly and communicative, and she answered every question I had. I highly recommend her if you've got a publishing contract to negotiate. You'll find out there are a lot of things your agent won't know, or won't bother to investigate, that Donya will be right on top of. As she reminded me, "Your agent is not a lawyer." Donya is."
