Project Description

In 2022, an individual in California sought assistance with reviewing an employee separation agreement after deciding not to renew their contract with their employer. The client faced challenges in securing timely legal help, prompting an extension from their employer to allow for a more comprehensive review of the agreement. They needed guidance on whether the terms were standard and fair, the rights they would waive by signing, and any obligations created by the agreement, which also referenced amendments to their personal service contract. As a result, the client received five proposals from licensed attorneys, with flat fee bids ranging from $410 to $600, all submitted within the requested deadline of less than a week.

Employee Separation Agreement

California

Asked on Mar 12, 2025

Can an employee be forced to sign a separation agreement that includes non-compete clauses?

I recently received a separation agreement from my employer, which includes non-compete clauses that restrict me from working in the same industry for a certain period of time. I am concerned about the potential impact on my career prospects and wonder if I can be legally compelled to sign such an agreement.

Answered Apr 25, 2025

Forced? No. Can they condition signature to receiving some form of severance? Yes. Can they condition it to receive a final paycheck of money earned? No. Can they include a non-compete in a separation agreement? Yes… but California has VERY employee-friendly laws related to non-competes. The specifics of the presented language in the agreement will matter and should be reviewed by competent counsel in your jurisdiction.
