Project Description

In 2024, a personal client in Tennessee sought assistance with drafting a living trust. The client aimed to establish this legal framework to ensure that, in the event of her passing, all assets and benefits would be held in trust and managed by her parents, with the intent to provide for her two minor children while preventing her ex-husband from accessing these resources. This was particularly crucial given that the ex-husband held shared legal custody but had not been involved in the children's lives for over ten years. As a result, the client received two proposals from licensed lawyers, with flat fee bids ranging from $1,000 to $1,499, all submitted to meet the client’s deadline of less than one week.

Hi. I'm not sure I understand your question. Everyone should have a will regardless of whether you have a trust. The question is whether you need a trust. A lot of that has to do with avoiding probate or some other potential uses depending on the goals and needs. But a typical family would use a trust to better organize everything and control distribution while avoiding going through the court process called probate.
