Project Description

In 2026, a personal client in Georgia sought assistance with an employee separation agreement, specifically requesting a quick second opinion on a six-page document related to a mutual separation and employment negotiations. The client already had primary legal counsel and was not looking to switch firms, but needed clarity on several confusing clauses, identification of any potential red flags under state law, and specific language suggestions to communicate back to their current attorney. With a preference for a flat fee due to the brief nature of the document, they also requested a rapid turnaround, ideally within 24 to 48 hours. As a result, the client received five proposals from licensed attorneys, with flat fee bids ranging from $240 to $500, all submitted in order to meet the requested deadline

Forum Questions About Employee Separation Agreement

Employee Separation Agreement

California

Asked on Mar 12, 2025

Can an employee be forced to sign a separation agreement that includes non-compete clauses?

I recently received a separation agreement from my employer, which includes non-compete clauses that restrict me from working in the same industry for a certain period of time. I am concerned about the potential impact on my career prospects and wonder if I can be legally compelled to sign such an agreement.

Answered Apr 25, 2025

Forced? No. Can they condition signature to receiving some form of severance? Yes. Can they condition it to receive a final paycheck of money earned? No. Can they include a non-compete in a separation agreement? Yes… but California has VERY employee-friendly laws related to non-competes. The specifics of the presented language in the agreement will matter and should be reviewed by competent counsel in your jurisdiction.

I would look into a good HR software package.
