How do I get the court to continue extending my 2 year battle of custody of my children who are decendents of a meskwaki tribal member?

I am an enrolled member of the Meskwaki Nation, a federally recognized tribe in Tama Iowa and have been trying to get my children back in my care who have been removed from me 2 years back and still am fighting to get them back. MFS(Meskwaki Family Services) are trying to move forward with permanency or guardianship of my 5 kids and to be placed with their family members. I have done almost everything they required expect drop random ua's due to my busy schedule. The allegations were I was living out of my car with my kids and was under the influence of methamphetamine which are inaccurate but I have no proof to uphold my argument in court.

The first question is there a child in need of assistance case open? Also, you need to be sure to drop the random ua's since that will help your position with MSF. Are you having visits with your children?

(aspiring pilot) Should I seek help regarding my personal statement for the FAA regarding past incidents involving alcohol?

The FAA wants court and police records of my incidents as well as a personal statement, in order to obtain my first class medical to start flight school. In college, I was charged with underage consumption which was dismissed and then a DWAI which was also dismissed. My BAC of the DWAI was .025 but I was 20 years old at the time. I don't want to put myself into a hole on the personal statement. Both these incidents happened in Colorado.

Are you talking about a UCC lien? See 810 ILCS 5/9-501 et seq. for some information about fraudulent filings. The Secretary of State also has a form for an Affidavit of Fraudulent Record which you could file. Additionally, you could file a termination which is also available with the Secretary of State.

My wife & I thought we had a contract from her employer to buy A dental practice after working for them for three years. We now were forced to sign a contract with the people that bought him out to continue working for them so they can get 10x EBITA when they sell shortly. Do we have a case for lost wages?

We moved from 30 miles away because we were told if we worked for 3 years we could buy it for $525,000. They now want $2.5M.

The first question is do you have a fully executed written contract? This is the first step to determine the terms and conditions such as your wages if there is a breach of contract, the dentist being able to assign the contract and if it can be modified.

If a service agreement is cancelled after 30 day notice does the payment terms agreement become invalid even if it was agreed to be for 15 months

I clean for a living I had contracted clients for office buildings they can't have 30 day notice for nothing but our terms state they will pay for 15 terms on first.of each month but stated would only pay have half this month due to 30 ending mid.month however agreement says payment due on first of 1407. Or service on be suspended until payment but do they owe for the next 3 months regardless

A contract is an agreement between parties on how they are going to conduct business with each other. What is written in the contract is crucial to being able to determine what the agreement of the parties truly is. Contracts are all about the words on the page and what they say exactly. A well-drafted contract will make the responsibilities of both parties very clear. A notice provision in a contract typically will say how much time a party has to give notice to the other party before the contract is terminated. This is different than what a term provision will say. For example, sometimes contracts will have language that says a contract cannot be terminated before the expiration of a certain time period. In that case, if one party terminates the agreement, full payment of the contract is still required to be made even if the service is not rendered. Other times, the term set forth in the agreement (e.g. 15 months) serves as a guarantee of price and other terms in the agreement. For example, "Contractor agrees to perform cleaning services to the Buyer for 15 months, at $XXX per month. At the end of the term, this contract will auto renew and will continue month to month until terminated by either party." Proration is a term that is used to describe when a partial payment can be made. If the contract does not allow for proration and instead gives a monthly payment, then the full monthly payment would be due. Contracts are all about what is written specifically in the contract. If terms are missing there can be interpretation of what the parties actually meant.

If a property is under contract as "seller financed" is it possible for the last buyer to enter into an option to buy contract with a new buyer?

The current owner of a property is under contract making monthly payments with the previous seller/title holder who is financing the loan. The property under contract is not occupied by the current owner. Another party is interested in buying the property, but desires to do research first, and would like to enter into a 6-12 month option to buy contract with the current owner. Is it possible for two contracts to exist on the same property?

Typically interests in real estate are assignable - meaning either the buyer or the seller could sell their rights under the contract to another party. An interested buyer could also enter into a contract where the second buyer have the right to buy the property even though the seller doesn't have full legal title to the property yet. Assuming there is no contractual provision restricting the assignment of rights under the contract, Buyer I and Buyer II could enter into an agreement that states that Buyer II would have the option to purchase Buyer I's interest under the contract. If Buyer II executed the option, then Buyer II would start making the payments are required by the contract. It's important to note that Buyer I would still be liable to make the payments to seller if Buyer II failed to do so. As an agreement between Buyer I and Buyer II does not change the contract between Buyer I and Seller. If the Seller is involved, the original contract could be amended or assigned to Buyer II. As an alternative, Buyer I and Buyer could enter into an agreement where upon Buyer II's executing their option to buy the real estate, Buyer II would provide funds to Buyer I, who would in turn pay Seller what is owned under the contract. Buyer I would then be obligated to convey the real estate to Buyer II. Depending on the facts there might be other alternatives or possible solutions. Each matter depends on the facts. An attorney would be able to review the transaction and make a determination of what the best course would be given the client's needs.
