Is a Dry-Hire mobile bartending service legal in WI?
Meaning we do not buy or sell any alcohol. We provide cups, napkins, straws, garnishes, a portable bar, and a server. The "client" provides us with the beverages served.
Hello! My name is Dolan and thank you so much for contacting me! I just had a few quick questions for you: Ok thanks! So the server will be supplying the beverages? Is the server an employee of yours?
My partner & I started an LLC, we do not have employees, we run it ourselves. So I would be the server.
I do see other Mobile bartending services in WI that do not have a liquor license. Liquor licenses are only issues to brick and mortar businesses. What I have been told is that as long as we are not purchasing or selling any alcohol it's legal. The client is not selling any alcohol either. They are giving it away to their guests. Like at a wedding in their back yard type deal.
So these are typically governed on a local (city or county) basis. For example, the City of Windsor says that anyone wishing to sell, deal, vend, or traffic in alcohol beverages within Windsor needs a license. So it's possible that some are operating illegally, but it depends on the location. What city and state is this in?
We are in New Richmond, WI
Ok based on the code, it doesn't look like you need one. You need a retail license in your city if you want to sell liquor, but not to serve it. - https://www.codepublishing.com/WI/Richmond/html/Richmond05/Richmond0505.html Does that help clarify things? I want to make sure I didn’t leave anything out.
Yes that helps. Thank you Dolan!!
For sure! Were there any details I missed? Were there any concerns you still needed to be addressed?
Not at the moment. I am going to stop at the New Richmond City offices on Monday and see what they have to say. If I need further assistance I will reach out to you.
