Contracts Legal Questions and Answers

Contract Agreement

South Carolina

Asked on Feb 1, 2022

I sold my house but was never paid

To avoid foreclosure, I spoke with a contractor to flip my house for me. He would pay my mortgage until it sold then pay it off and keep the profit. I walk away with the mortgage company paid, but I was fouled. He isn't paying the mortgage after I signed the contract. I'm concerned he will be able to sell it now himself without the mortgage company ever being paid.

Christopher B.

Answered Feb 8, 2022

There are many issues involved in this question. I would need to see the original deed and mortgage on your house plus the contract you signed with the contractor. The original mortgage almost certainly had an acceleration clause stating that if you sold the property, then the full mortgage becomes due. Going after the contractor might be possible but other avenues would more likely be the better route to keep your house from being foreclosed. Will also need to see if your contract gives ownership to the contractor or just the right to sell on your behalf. Lots of additional questions that need documents to give you your options.

Consulting Agreement

Asked on Nov 4, 2023

How to terminate a consulting agreement?

I recently entered into a consulting agreement with a client. After a few months, I have realized that the terms of the agreement are not beneficial to me and I would like to terminate it. I would like to know what legal steps I need to take in order to terminate the agreement and what potential repercussions I may face.

Diane D.

Answered Dec 19, 2023

That's why you should read the agreement before you sign it and bring it to an attorney to review. Termination conditions of the contract should be in the contract. You have to follow those. If you don't like them, you can ask the other party if you can change them or if you can break the contract. If they don't agree, you're stuck and will be in breach if you try to cancel it. You can cancel it if the other party breaches it, but you have to have a valid reason or the courts will not grant it and you will end up with major legal bills.

Agreement And Release

North Carolina

Asked on Sep 27, 2022

We signed a contract with a travel baseball team and in the middle of a game the coach lost it and started cussing in front of my son. Is that a breach of contract?

This is what we initialed. NCBA Team Players will carry themselves and conduct themselves with the highest degree of integrity and class. We expect to set the standard for sportsmanship, respect of the game, respect of our opponents, respect for the umpires and everyone that allows us to play this great game. Our appearance will be professional and our manners will reflect our character. Language not conducive to these standards will not be tolerated. These simple rules allow you to represent your family name, the game of baseball and the NCBA at all times with class on and off the field of play

Richard G.

Answered Sep 28, 2022

That clause addresses the NCBA Team Players' conduct. I would need to see the entire agreement to know what the coach's obligations are, if any.

Consulting Agreement

Asked on Nov 4, 2023

Can I modify a consulting agreement later?

I am a small business owner who recently hired an independent contractor to provide consulting services. We have drafted a consulting agreement that includes the terms of our arrangement, but I am now considering making modifications to the agreement. I am seeking advice from a lawyer to understand the legal implications of modifying the agreement.

Jeffrey A.

Answered Nov 14, 2023

Hi there, Yes, you can modify a consulting agreement by preparing an amendment, and having both you and the independent contractor sign it. The key is having the contractor first agree to any changes in principle, and then making sure the amendment (1) accurately reflects those changes, and (2) includes other standard language ensuring the continued integrity and enforceability of the original agreement.
