I recently left my job after two years of employment and my former employer has asked me to sign a separation agreement. I am unsure if I am legally obligated to sign this agreement or if employee separation agreements are required by law. When an employee leaves a company, an employer can offer severance agreement/separation agreement/termination agreement, where employer offers a severance package to the employee (e.g., lump sum money, extended benefits) in exchange for limiting their liability (e.g., release of certain legal claims, confidentiality provisions). An employee can decide whether to accept the severance agreement as-is, whether to negotiate for more favorable terms or to reject the offer. You may consult an attorney to review the severance agreement to understand your rights, obligations, the benefit you are receiving, and the claims you are waiving.

How to track dental associate contracts?

I am a dentist who is looking to hire a dental associate to help with my practice. I need to create a contract that outlines the terms and conditions of the associate's employment, but I want to make sure that I am tracking it properly. I want to make sure that I am following all the legal obligations related to the contract and that it is enforced properly.

It's not necessary to write a contract - you can write a hiring letter with the terms and conditions, with a reminder that the employee is an "at will" employee. This may give you more freedom to discipline or terminate the employee than an employment contract would. However, you can also write this up as a contract. In either instance, do not violate any laws, such as the state and federal laws against discrimination (some counties and cities, such as King and Spokane counties, and Tacoma, Seattle, and possibly Spokane may have additional provisions); watch out for RCW 49.44.211, a 2022 law about nondisclosure and nondisparagement provisions; and, if you choose to include regular evaluations in your letter or contract, the most simple thing is to track those on a calender and remind yourself and your employee of the date a few weeks ahead of time. Some hiring letters and employment contracts provide for reimbursing the employer for the costs of training and/or any costs provided to the employee for moving expenses if the employee leaves before "X" amount of time.. Before hiring any new employee, do your best to conduct a national background check (not just state) and make sure it's extensive - prior performance at another job? Was the work history and education what they say it was? Any misdemeanors or felonies? What is their financial history and credit rating? Etc. Good luck on your hiring decisions.

Can my criminal record affect my eligibility for an occupational license?

I am currently in the process of applying for an occupational license in order to work in a regulated profession, but I have a previous criminal record that includes a non-violent offense from several years ago. I am concerned that this record may negatively impact my eligibility for the license, and I would like to know if my criminal history can affect my chances of obtaining an occupational license.

While having a criminal conviction may negatively impact your eligibility for a license, it depends on the specifics of your case. Licensing boards typically evaluate the nature of the offense, how much time has passed since the conviction, and whether the offense is substantially related to the duties of the profession. A non-violent offense from several years ago may not be a barrier to licensure, especially if there is evidence of rehabilitation, there is no subsequent criminal history, and the crime is not substantially related to the purpose of the license. Many jurisdictions have adopted laws or policies aimed at reducing the impact of old or unrelated convictions on occupational licensing decisions. Boards often conduct individualized assessments and may consider factors such as your conduct since the offense, completion of sentencing terms, letters of recommendation, and your overall fitness to practice in the profession. A North Carolina-licensed attorney may be best suited to answer the specifics with regards to your license in North Carolina. If you are concerned about how your record might affect your application, it may be wise to review your criminal history, gather supporting documentation showing rehabilitation, and consult an attorney familiar with occupational licensing in your state. In some cases, I recommend pursuing an expungement or record sealing may also improve your chances in the future.
