What type of attorney would I hire for a problem with a HVAC contractor that installed the wrong size of equipment.

I hired a HVAC company to install a new heating and cooling system to replace existing units. The problem is they installed undersized units

Dean F.

Answered Dec 9, 2022

A civil litigation attorney can help you resolve a dispute with an HVAC contractor. They typically will help you try to resolve the issue prior to filing suit. And if that does not resolve it, they are experienced in litigating matters in court.

Employee Benefits Agreement

Asked on Mar 21, 2023

Do you take cases for unemployment overpayment benefits?

In 2020 during covid my business was forced to shut down. I was also working, I had a job and I owned an event planning business. before filing for UI I called in to ensure I was able to file for the PUA for my business. I was told by the representative yes I can. in her words she said "anyone can apply for the PUA" she did not explained to me that I cannot apply if I had another job, or what the conditions were, as I have never filed for or been on unemployment in my life until covid happened. In september 2022 I received a letter stating that I was overpaid benefits in the amount of $62000. I filed for a weaver which I was not qualified for, then I appealed and the judge ordered a recalculation and that amount went from $62K to $58K. I cannot pay this money and I need help in fighting that this was not my fault. My taxes will be garnished every year until this is paid off. I am hoping someone out there can be of assistance to me, I really need it.

Donya G.

Answered Apr 4, 2023

Hello, I am sorry for the mix up. I worked with a client last year with similar circumstances. She was overpaid as well. We had a hearing and it was determined, since she had never filed before and English is not her first language that she had not done it intentionally so that fine on the payment was removed. That being said, if you were overpaid, you will need to repay the amount. She signed up on a payment plan. I suggest you do the same. If you need to engage my services to assist you, you can find me on Contracts Counsel website or my personal page Regards Donya Gordon

Contract Agreement

Utah

Asked on Jul 29, 2021

Should I sign a contract if I don't understand what it is saying?

Has a contract with someone where if we disagreed we would go to mediation. They refused to go, they offered us a settlement as long as we signed another contract. I don't understand fully what it is saying.

Donya G.

Answered Oct 5, 2021

Absolutely NOT. You never sign ANYTHING you do not understand because when you sign, you become bound to those terms whether you understood them or not or whether you agree with them or not. Should you later have a disagreement on the contract you signed, the court, or arbitrator will see your signature on the document as a sign that you read, understood and agreed to the terms. You will need to hire an attorney to review the initial agreement to see if they can refuse mediation as well as to look at the new contract and let you know what it says and whether you should sign it or not. I am a contracts attorney and if you you would like my services, you can contact me on the contracts counsel website.

Booking Contract Dispute - Who has jurisdiction?

I recently booked a property rental through VRBO. I left a review of the property and now the property owner is threatening legal action if I don't take down my review. The property is in Turks & Caicos, the property owner resides in Canada and I live in the United States. What country has legal jurisdiction and who/where would I go to seek legal counsel?

Donya G.

Answered Feb 15, 2022

You should go to VRBO terms and conditions. The document should list where disputes should be held. Since both you and the owner are users of the site, you are both bound by the terms. If your review was based on your experience, another option is to do a cease and desist, but I would need to discuss the matter with you in order to fully assist. you can reach out to me via Contracts Counsel. All the best Donya Gordon

I had a new kitchen done and they are still unable to match the crown molding and had tried numerous toe Also he did not follow the contract and kitchen is cheap mess I paid over 450,000 he claims theyu his attorney $25,000

Donya G.

Answered Oct 5, 2021

You will need an attorney that handles disputes. What does your contract say about disputes? Generally there is a section that outlines what the parties will do if they don't agree, is it litigation or arbitration? If it is litigation, what state law applies to your contract? That will also be in your document? depending on what your contract states, that is what you will need. I am a contracts attorney and have handled disputes including arbitration with AAA. If you you would to engage my services where I would review your agreement and advise you, you can contact me on the contracts counsel website and I would be happy to assist. Best Regards, Donya Gordon
