Employment Legal Questions and Answers

Stock Option Agreement
Connecticut
Stock option agreement confidentiality?
I recently signed a Stock Option Agreement with my employer. After signing the agreement, I was provided with a confidentiality clause. I am concerned about the terms of this clause, and what it means for my ability to discuss the agreement with others. I am seeking advice on the potential legal implications of this clause, and what I can and cannot do.
Thomas L.
Confidentiality clauses are becoming regulated by the various states. At a minimum, your clause (regardless of what it says) will not prevent you from talking to a lawyer or to government officials.

Employment handbook disciplinary policy?
I am an employee at a large company and I recently received a disciplinary action for an incident that occurred in the workplace. I was given a copy of the company's Employee Handbook, but I am not sure what the disciplinary policy is or what the consequences are for violating the policy. I would like to understand the disciplinary policy so that I can better understand the disciplinary action taken against me.
Diane D.
You would have to submit the policy to an attorney so that it can be explained to you. You can submit a work order through ContractsCounsel.

Employment handbook harassment policy?
I am a manager at a company that recently updated its employee handbook. I noticed that the new handbook does not include a policy for harassment, and I am concerned about how to handle such issues in my work environment. I am looking for an attorney to provide advice on the best way to implement a harassment policy and ensure that the policy is compliant with all applicable laws.
Diane D.
You need to find an attorney that does employment law and HR law. If you want, you can contact me, and I can help. I am very familiar with harassment policies and the applicable laws, and have participated in creating handbooks for employees.

Physician Employment Agreement
Florida
Are physician employment agreements required?
I am a physician who is considering a new job opportunity. I have been presented with an employment agreement, but I am unsure if I am legally obligated to sign it. I am looking for guidance on the legality of physician employment agreements and whether or not I am required to sign one.
Daniel D.
Physician employment agreements are not required by Law but that does not mean they are not required by the Employer. Employers have these agreements in place to set the terms of the employment regarding salary, length of employment and any other relevant terms that they want the employee to agree to. But, that also means you as the employee could negotiate provisions into the agreement that you want if the employer is willing to put them in. You legally don't have to sign one, but your future employer can still require a signed agreement. Before you sign anything you should make sure you understand the terms and provisions of the agreement.

Fired
I'm a independent contractor as a caregiver and I was fired for no reason
Melissa L.
Depending on your State's employment laws, usually an employee is hired as an employee at will meaning that employee can be fired or terminated at any time for no reason as long the reason is not illegal/discrinatory. If you do not have a written employment contract, the default is usually employee at will. Sorry to hear about your loss of job.
Quick, user friendly and one of the better ways I've come across to get ahold of lawyers willing to take new clients.
