Settlement Agreement
Illinois
Can settlement agreements include non-monetary terms?
I recently entered into a settlement agreement with another party, and I am trying to determine whether non-monetary terms can be included in the agreement. I am concerned about potential liabilities and obligations that may arise from the agreement if non-monetary terms are included. I would like to know what legal considerations I should take into account when crafting the agreement.
Andre T.
Settlement agreements can contain any provisions that the parties are willing to agree to provided that those provisions are not illegal or against public policy. There are also safe guards that can be included in the language of the agreement so that legally enforceable terms are undisturbed even if part of the agreement may be found to be invalid.

Independent Contractor Agreement
Massachusetts
Can an independent contractor agreement be modified after it has been signed?
I have been working as an independent contractor for a company for the past year and recently encountered some issues with the terms outlined in my original independent contractor agreement. The agreement was signed when I first started working with the company, but due to changes in the scope of work and additional responsibilities that were not initially anticipated, I am wondering if it is possible to modify the agreement to reflect these changes. I want to ensure that my rights and obligations are properly outlined and that I am protected legally in this working relationship.
Richard G.
Yes, generally, an independent contractor agreement can be modified after it has been signed. However, any changes must be made formally and typically require the consent of both parties involved. Here’s how to properly modify an independent contractor agreement...although (caution here) I would contact a business/employment law attorney such as myself: 1. Draft a Written Amendment Create an Amendment: Prepare a written amendment or addendum to the original agreement. This document should clearly specify the changes being made and reference the original agreement. Include Details: Clearly outline what parts of the original agreement are being modified and include any new terms or conditions. 2. Get Mutual Agreement Both Parties’ Consent: Both the contractor and the client must agree to the changes. This means both parties should review and approve the amendment. Signature: Both parties should sign the amendment to make it legally binding. It’s a good idea to have each party retain a copy of the signed amendment. 3. Review and Update Documentation Original Agreement: Ensure that the original agreement and any amendments are kept together and clearly documented. Consistency: Make sure that any changes made are consistent with the overall terms of the agreement and applicable laws. Consult an Attorney: Depending on the complexity of the changes, it may be wise to consult with a legal professional to ensure that the modifications are legally sound and properly documented.

Noncompete Agreement

Noncompete agreement and public policy?
I recently accepted a job offer with a new employer who asked me to sign a noncompete agreement. I am concerned that the agreement may not be in line with public policy and wanted to get a professional opinion from a lawyer to make sure I am not putting myself in a difficult situation.
Merry K.
If you are in Washington State, where I'm licensed, as opposed to D.C., please let me know what kind of help you are looking for - have you already signed the agreement? I've been a WA State attorney for nearly 38 years, and specialize in employment law.

Employment handbook family leave policy?
I recently accepted a position at a new company and I was given an employee handbook to review prior to my start date. I noticed that the handbook does not include any information on family leave policies. I am wondering what the company's policies are related to family leave and how they may affect my employment. I would like to understand my rights and responsibilities as an employee when it comes to family leave.
Gregory F.
Generally, employers must have at least 50 employees at your location or within a 75-mile radius of your location to be covered under the FMLA. Further, employees of covered employers are not eligible for FMLA leave until they have been employed for at least 1 year and have worked at least 1,250 hours within the past 12 months.

Employee Separation Agreement
North Carolina
How to draft an employee separation agreement?
I am a small business owner and recently had to let go of an employee. I need to ensure that all of our interests are protected and that everything is done according to the law. I am looking for guidance in drafting an employee separation agreement that would be suitable for both parties.
N'kia N.
Generally speaking, an employee separation agreement should address rights, responsibilities, and restrictions. As applicable, this typically includes pay and benefits (such as final pay, severance pay or garden leave pay, COBRA, 401K, and stocks); return of company property; release of claims; and restrictive covenants (such as non-competition, non-disclosure/confidentiality, and non-disparagement). The agreement may also include other agreed-upon or required terms (such as eligibility for rehire and reference to the Age Discrimination in Employment Act/Older Worker Benefit Protection Act). This is just general guidance, as what is most appropriate for an employee separation agreement varies depending on specific circumstances.
Quick, user friendly and one of the better ways I've come across to get ahold of lawyers willing to take new clients.
