Can a Release and Waiver Agreement protect me from liability if someone gets injured while participating in an activity I organized?

I recently organized a charity event where participants engage in physically demanding activities such as obstacle courses and sports. I want to ensure that I am not held liable for any injuries that may occur during the event, so I am considering having participants sign a Release and Waiver Agreement. However, I am unsure if this agreement would actually protect me from potential legal claims and if there are any specific requirements or limitations I should be aware of when drafting the agreement.

First, if a participant is under 18, their parent or legal guardian must sign for them. Second, all these types of releases/waivers do is slow people down or discourage them from suing, but a good attorney can get around most of these (especially ones you buy off the internet). You should, at a minimum, make a good effort to ensure that all activities are as safe as possible, and also make sure you, your Board members, staff, and the organization are covered by solid insurance. I'm not trying to discourage you - I just want you to be very careful.

We are in the process of negotiating a SaaS agreement with a potential customer and I am looking to understand what rights the customer will have to the data that they provide to us. We want to make sure that we are adequately protecting our intellectual property while also providing the customer with the ability to use the data they provide.

Can I terminate a landscaping contract if the contractor has failed to meet the agreed-upon deadlines?

I entered into a landscaping contract with a contractor to redesign my backyard, which included various tasks such as installing a patio, planting trees, and laying down new turf. The contract specified that the work would be completed within six weeks. However, it has been over three months, and the contractor has consistently failed to meet the agreed-upon deadlines, causing significant inconvenience and frustration. Can I terminate the contract due to the contractor's breach of the agreed-upon timeframe?

Usually, yes, but it depends in the terms and conditions of the signed agreement, and what steps you have taken to date (such as written correspondance with the contractor) to try to get the landscape contractor to fullfil the contract. Can a company be held liable for not meeting the service level agreement outlined in a contract?

I recently entered into a contract with a software development company to build a custom application for my business. The contract included a service level agreement (SLA) that outlined specific performance metrics and guarantees for the software. However, since the project started, the company has consistently failed to meet these performance metrics, causing significant delays and impacting the functionality of the application. I want to understand if the company can be held legally liable for not meeting the SLA and if I have any recourse to seek compensation or terminate the contract due to their failure to meet the agreed-upon terms.

Yes. A SLA in a written contract is part of that contract. And even without a specifically-stated remedy, you may be able to sue for breach. It's not all cut-and-dried, however, as there can be a multitude of other contractual limitations or considerations that would need to be considered after a thorough review of the agreement, the documentation of the work that's been done and any type of waivers provided for missing the SLAs.
